FACT SHEET FOR S.C.R. 1042 
 
support; Texas; southern border 
Purpose 
Expresses the Legislature's support to: 1) the people of Texas; 2) the Texas National Guard; 
3) the Texas Department of Public Safety; 4) Texas Governor Gregg Abbott; and 5) all personnel 
acting pursuant to their lawful authority to secure our nation's southern border.  
Background 
Article I, section 8 of the U.S. Constitution gives the U.S. Congress the power to make all 
laws which must be necessary and proper for carrying into execution the foregoing powers, and 
all other powers vested by this Constitution in the government of the United States, or in any 
department or officer thereof (U.S. Const. art. 1, § 8). 
Article IV, section 4 of the U.S. Constitution requires that the United States guarantee to 
every state a republican form of government and must protect each of them against invasion and, 
on application of the Legislature or the Executive, against domestic violence (U.S. Const. art. 4, § 
4). 
Article I, section 10, clause 3, of the U.S. Constitution states that no state must, without the 
consent of Congress, lay any duty of tonnage, keep troops, or ships of war in a time of peace, enter 
into any agreement or compact with another state, or with a foreign power, or engage in war, unless 
actually invaded, or in such imminent danger as will not admit of delay (U.S. Const. art 1, § 10). 
There is no anticipated fiscal impact to the state General Fund associated with this legislation.  
Provisions 
1. Expresses the Legislature's support for: 
a) the people of Texas;  
b) the Texas National Guard; 
c) the Texas Department of Public Safety; and  
d) all personnel acting pursuant to their lawful authority to secure our nation's southern 
border.  
2. Expresses that the Legislature of the State of Arizona supports Texas Governor Greg Abbott 
in his fight for secure borders and is of the opinion that Arizona Governor Katie Hobbs should 
do the same.  
3. Declares that the Arizona State Legislature is of the opinion that President Joe Biden must 
fulfill his duty to repel the invasion America faces at its southern border.
