Purpose
Adds, to the criteria allowing a vehicle owner to participate in the Voluntary Vehicle Repair
Program (VVRP), that the vehicle owner repair the vehicle not more than 60 days after acceptance
into the VVRP.
Background
The Director of the Arizona Department of Environmental Quality (ADEQ) must
administer a comprehensive annual or biennial Vehicle Emissions Inspections Program to require
the inspection of vehicles in Arizona. The Director of ADEQ must operate and administer the
VVRP in areas that are subject to the Vehicle Emissions Inspections Program. The VVRP must
provide quantifiable emissions reductions and operate and administer the VVRP in cooperation
with the county that provides up to $900 to vehicle owners who qualify for the VVRP and pay a
$100 copayment. A vehicle owner can participate in the VVRP if the following statutory criteria
are met: 1) the owner is willing to participate; 2) the vehicle being repaired is functionally
operational; 3) the vehicle being repaired is titled in Arizona; 4) the vehicle being repaired has
failed the Emissions Inspection Test and the owner of the vehicle applied to the VVRP not more
than 60 days after failing; 5) the vehicle being repaired has been registered during the immediately
preceding 12 months and has not been unregistered for more than 60 days; 6) the emissions control
system has not been tampered with; and 7) the emissions control system has not been removed or
disabled in whole or in part. Participation in the VVRP is limited to one vehicle per owner and
motor homes, motor cycles and salvage and fleet vehicles are not eligible to participate (A.R.S. ยงยง
49-542 and 49-558.02)
There is no anticipated fiscal impact to the state General Fund associated with this
legislation.
Provisions
1. Adds, to the criteria to participate in the VVRP, that the vehicle owner must repair the vehicle
not more than 60 days after acceptance into the VVRP.
2. Removes the criteria for ADEQ to administer the VVRP in cooperation with the county as
outlined.
3. Removes failing any random roadside vehicle test conducted by the state from the criteria that
allows diesel powered motor vehicles with a gross vehicle rating of more than 8,500 pounds
that are subject to the Vehicle Emissions Inspection Program eligible for up to $1,000 in repair
costs from the VVRP. FACT SHEET
