HB 2128 Initials CW Page 1 House Engrossed ARIZONA HOUSE OF REPRESENTATIVES Fifty-seventh Legislature First Regular Session House: NREW DP 8-2-0-0 HB 2128: environmental remediation; liability; release Sponsor: Representative Bliss, LD 1 House Engrossed Overview Establishes and outlines obligations of prospective remediators for a contaminated site on the Water Quality Assurance Revolving Fund (WQARF) registry. History Remediation is action taken to address a contaminant by reducing the level of the contaminant in the environment or preventing or reducing exposure to the environment (A.R.S. § 49- 171). The WQARF Registry is a list compiled by the Arizona Department of Environmental Quality (ADEQ) that lists sites that may pose a risk to public health or the environment due to hazardous substances. The sites must have ongoing or planned investigation and cleanup. There are currently 38 sites on the WQARF Registry (ADEQ). Provisions 1. Defines: a) prospective remediator; and b) prospective remediator agreement. (Sec. 1) 2. Adds prospective remediator to statutes, for prospective purchasers of sites on the WQARF registry or where ADEQ has identified contamination of the facility, relating to: a) agreements; b) assignments; c) notices; d) fees; and e) authority. (Sec. 2,3,4 and 5) 3. Requires the Director of ADEQ's determination upon demonstration by prospective remediator, that the remediator has the technical capability, financial capability and requisite access to the facility necessary to perform substantial remediation at the facility.
