History The Governor's Regulatory Review Council (Council) consists of six members appointed by the Governor and is administered by the director or assistant director of the Department of Administration. The Council's duties include reviewing and approving state agency rules and their preambles and economic, small business and consumer impact statements. Additionally, the Council hears appeals regarding agency practices, substantive policy statements and periodically reviews each agency's rules. (A.R.S. §§§ 41-1051, 41-1052, 41- 1056) Provisions 1. Continues, retroactive to July 1, 2025, the Council for 2 years until July 1, 2027. (Sec. 4, 5, 8) 2. Allows a person to petition the Council to review an agency practice, substantive policy statement, final rule or regulatory licensing requirement that the petitioner alleges violates a person's fundamental legal rights. (Sec. 1) 3. Requires the Council to notify an agency within ten days after the third Council member has requested a public meeting that a matter related to an agency has been placed on the agenda for consideration of its merits. (Sec. 1) 4. Requires the director or assistant director of the Department of Administration to administer the council. (Sec. 2) 5. Prohibits the assistant director from being general counsel for the Department of Administration. 6. Requires the director or assistant director be a member and chairperson of the Council and oversee legal and economic analysis of any rules received by the Council. (Sec. 2) 7. Describes the required members of the Council and who can appoint them. (Sec. 2) 8. Requires the Council staff to independently review the state constitution and relevant rules and advise the Council on constitutionality of a rule independent of an agency's statutory justification of the rule. Requires Council Staff distribute all council meeting material to the President of the Senate and the Speaker of the House of Representatives at the same time materials are distributed to members of the Council. (Sec. 2) 10. Prohibits the Council from voting to approve a rule during a study session. (Sec. 3) 11. Clarifies the Council can only vote to approve a rule at a Council meeting following each study session meeting. (Sec. 3) 12. Requires Council meetings open for public comment allot equal amounts of time to individuals who support and oppose the rule. (Sec. 3) 13. Allows individuals serving on the Council on the effective date of the measure to continue serving until the expiration of their term and establishes an order for appointing new members (Sec. 7). 14. Repeals the Council on January 1, 2028. (Sec 4) 15. Contains a legislative intent clause. (Sec. 6) 16. Defines study session. (Sec. 3)
