amending title 13, chapter 31, Arizona Revised Statutes, by adding section 13-3123; appropriating monies; relating to concealed weapons permits.

Be it enacted by the Legislature of the State of Arizona: Section 1. Title 13, chapter 31, Arizona Revised Statutes, is amended by adding section 13-3123, to read: START_STATUTE13-3123. Firearm sales; concealed weapons permit validation; prohibited data collection A. Notwithstanding section 13-3112, subsection J, the department of public safety shall maintain a secure website portal that allows a federally licensed firearms dealer to check the permit status of any person who presents the federally licensed firearms dealer with a concealed weapons permit issued pursuant to section 13-3112. B. If a person who is purchasing or receiving a firearm in this state presents a concealed weapons permit issued pursuant to section 13-3112 to a federally licensed firearms dealer, the federally licensed firearms dealer shall confirm the validity of the permit by checking the department of public safety's secure website portal. If the permit is invalid, the federally licensed firearms dealer must conduct a background check before selling or providing the person with a firearm. A federally licensed firearms dealer may query the secure website portal only when presented with a concealed weapons permit by a person who is purchasing or receiving a firearm. C. The department of public safety may not retain or collect data on the number of concealed weapons permit queries made by federally licensed firearms dealers. END_STATUTE Sec. 2. Appropriation; department of public safety; development and maintenance of a secure website portal The sum of $300,000 is appropriated from the school safety interoperability fund established by section 41-1733, Arizona Revised Statutes, in fiscal year 2025-2026 to the department of public safety for the cost of developing and maintaining a secure website portal that is prescribed by section 13-3123, Arizona Revised Statutes, as added by this act.
