Assigned to RAGE AS PASSED BY COMMITTEE ARIZONA STATE SENATE Fifty-Seventh Legislature, First Regular Session AMENDED FACT SHEET FOR H.B. 2626 manufactured housing; certification; compliance Purpose Modifies certification requirements relating to manufactured housing. Background The Office of Manufactured Housing (OMH), established within the Arizona Department of Housing (ADOH), is responsible for maintaining and enforcing quality and safety standards for, and installation of, manufactured and mobile homes, factory-built buildings and accessory structures. The affairs of the OMH must be conducted consistently with minimum standards of the U.S. Department of Housing and Urban Development (HUD) to be the designated agency for manufactured homes and related industries. The OMH must implement all existing laws and regulations mandated by the federal government, its agencies and Arizona for such purposes (A.R.S. § 41-4002). ADOH is responsible for establishing a state inspection and design approval bureau within ADOH and issuing a certificate to indicate compliance with the statutory construction and installation requirements. ADOH is required to enter and inspect or investigate premises at reasonable times, after presentation of credentials by the Director of ADOH or personnel of the OMH or under contract with the OMH, where regulated units are manufactured, sold or installed, to determine if any person has violated statute or statute adopted rules (A.R.S. § 41-4004). Each manufactured home for sale or lease in the United States must have a permanent certification label (label) affixed to each transportable section. The label must be separate and distinct from the data plate which the manufacturer is required to provide. The label certifies that, to the best of the manufacturer's knowledge and belief, the manufactured home has been inspected in accordance with HUD requirements and is constructed in conformance with the federal manufactured home construction and safety standards (24 C.F.R § 3280.11). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1. Removes the requirement for ADOH to issue a certificate to indicate compliance with statutory installation requirements. 2. Becomes effective on the general effective date.
