An Act

 

amending section 32-3213, Arizona Revised Statutes; relating to health professionals.

 Be it enacted by the Legislature of the State of Arizona: Section 1. Section 32-3213, Arizona Revised Statutes, is amended to read: START_STATUTE32-3213. Health professionals; disclosure; unprofessional conduct; definition A. An advertisement for health care services that includes a health professional's name shall identify the title and type of license the health professional holds and under which the health professional is practicing. A health professional shall use only the appropriate title or titles as indicated in the applicable statutes regulating that person's health profession. B. A health professional who violates this section commits an act of unprofessional conduct and is subject to enforcement by the applicable health profession regulatory board. If a violation of this section also constitutes an unlawful practice pursuant to section 44-1522, the attorney general may investigate and take appropriate action as prescribed in title 44, chapter 10, article 7.  C. For the purposes of this section, "advertisement": 1. Includes business cards, identification badges, letterhead, billboards, brochures, pamphlets, radio and television scripts, electronic media, printed telephone directories, telephone and direct mail solicitations and any other means of promotion to patients or clients and prospective patients or clients intended to directly or indirectly induce any person to enter into an agreement for services with the health professional. Advertisement 2. Does not include materials that provide information about network providers and that are created by an entity regulated under title 20. END_STATUTE 

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 32-3213, Arizona Revised Statutes, is amended to read:

START_STATUTE32-3213. Health professionals; disclosure; unprofessional conduct; definition

A. An advertisement for health care services that includes a health professional's name shall identify the title and type of license the health professional holds and under which the health professional is practicing. A health professional shall use only the appropriate title or titles as indicated in the applicable statutes regulating that person's health profession.

B. A health professional who violates this section commits an act of unprofessional conduct and is subject to enforcement by the applicable health profession regulatory board. If a violation of this section also constitutes an unlawful practice pursuant to section 44-1522, the attorney general may investigate and take appropriate action as prescribed in title 44, chapter 10, article 7. 

C. For the purposes of this section, "advertisement":

1.
