Assigned to JUDE FOR COMMITTEE ARIZONA STATE SENATE Fifty-Seventh Legislature, First Regular Session FACT SHEET FOR H.B. 2767 voter registrations; transportation department; recorders Purpose Effective January 1, 2026, requires the Arizona Department of Transportation (ADOT) to send voter registration information to both the Secretary of State (SOS) and the appropriate county recorder simultaneously. Background Pursuant to the National Voter Registration Act of 1993 (NVRA), states must provide a voter registration application form for elections for federal office as part of an application for a driver license. The voter registration application portion of a driver license application: 1) may not require any duplicative information from an applicant's driver license form, with certain exceptions; 2) may require only the minimum information necessary to prevent duplicate voter registration and enable state election officials to assess the eligibility of the applicant; 3) must include a statement that outlines each state's eligibility requirements, contains the applicant's attestation of meeting such requirements, and requires the applicant's signature under penalty of perjury; 4) must include outlined information relating to voter registration requirements and confidentiality notifications; and 5) must be made available to the appropriate state election official as provided in state law (52 U.S.C. 20504). The Director of ADOT (Director) and the SOS must consult at least every two years regarding voter registration at driver license offices to adopt rules regarding voter registration at such offices, in consultation with all county recorders. The rules must: 1) provide for substantial conformity between the license application and the voter registration; 2) allow for the transfer of driver license information and voter registration information from ADOT to the voter registration rolls; 3) respect all rules and statutes of Arizona concerning the confidentiality of driver license application information; 4) provide for manual or electronic generation and transmittal of voter registrations and other outlined information in conformity with NVRA. ADOT must also provide each applicant a statement that provides each eligibility requirement for voting, including citizenship, as well as other prescribed requirements according to NVRA (A.R.S. ยง 16-112). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1. Requires ADOT, when receiving voter registration information and notwithstanding any other law, to simultaneously transmit the information directly to the SOS and the appropriate county recorder. 2. Specifies that ADOT is prohibited from transmitting such information through the SOS. FACT SHEET H.B. 2767 Page 2 3. Requires ADOT to ensure that all voter registration information collected at driver license offices, including names, addresses, dates of birth and digitized signatures, are sent to appropriate county recorders within five business days after receipt of a completed registration application, request for renewal or revision to the registration information. 4. Specifies that, except for voter registration purposes, this legislation does not preclude ADOT from providing voter registration information to the SOS for purposes other than those prescribed. 5. Stipulates that this legislation does not diminish or alter the duties of the SOS under state or federal law regarding voter registration and election administration. 6.
