HCR2031: land trust; distributions; common schools

Overview 
Alters the amount of money that can be distributed from the permanent state school fund 
and establishes requirements for distributing and using the money from the fund. 
History 
Proposition 123 increased the annual distributions from the permanent school fund to 
schools, universities and other public institutions from 2.5% of average market values to 6.9% 
requiring inflation adjustment for ten fiscal years following FY 2015. It provides guidelines 
by which inflation adjustments may be suspended depending on the economic circumstances 
facing the state. It is set to expire in FY 2025 (JLBC, Legislative Council). 
Provisions 
1. Requires the distribution from the permanent state school fund be five percent of the 
average monthly market values of the fund for the immediately preceding five calendar 
years. (Sec. 1) 
2. Requires the legislature starting in FY 2026 to appropriate money distributed in this 
measure to the Superintendent of Public Instruction for distribution to public schools as 
described in the following provisions. (Sec. 1) 
3. Removes provisions allowing for the Legislature to reduce the distribution of funds with 
the approval of the Governor. (Sec. 1) 
4. Requires the Superintendent of Public Instruction to annually allocate money based on 
the weighted student count of each public school to support the cost of increasing wages.

5. Specifies that schools receiving money must: 
a) use the money only for costs incurred to increase the wages of eligible teachers; 
b) ensure the increase is the same for all eligible teachers; 
c) post the percentage increase on the website of each public school; 
d) use money to supplement and not supplant existing federal, state and local funding 
for teacher compensation. (Sec. 1) 
6. Specifies a teacher is eligible to receive an increase if they meet the following 
requirements: 
a) are employed as a full-time classroom teacher; 
b) meet or exceed teacher performance standards determined by the state;

c) spend more than 75 percent of their time at work on non-administrative activities and 
classroom instruction; 
d) are employed in a public school in compliance with all reporting and auditing 
requirements established by the Legislature. (Sec. 1) 
7. Contains a legislative intent clause. (Sec. 2) 
8. Requires the Secretary of State to submit the measure to voters for a special election in 
2025. (Sec. 2)
