Sponsor: Senator Shamp, LD 29
Committee on Public Safety & Law Enforcement
Overview
Instructs constables to notify the county Board of Supervisors (BOS) of office appointments.
History
With BOS approval and salary limitations, constables can appoint deputies, stenographers,
clerks and assistants to conduct the affairs of their office. All appointments must be made in
writing. Deputies must be certified by the Arizona Peace Officer Standards and Training
Board (AZPOST) to enforce Arizona laws. Their qualifications include being a United States
citizen and meeting their physical, mental and moral fitness qualifications (A.R.S. §§ 22-131
and 41-1822).
Constables serve, execute and return all warrants, notices and processes within their county
directed to them by their county's Justice of the Peace (JP) or competent authority.
Constables are required to attend JP court in their precincts when needed. When elected or
appointed by BOS, constables have the authority of a peace officer when performing official
duties and have the same powers, duties and legal responsibilities as sheriffs, except where
differences apply (A.R.S. § 22-131).
