AN ACT

 

amending title 6, chapter 12, Arizona Revised Statutes, by adding article 3; amending section 43-222, Arizona Revised Statutes; amending title 43, chapter 10, article 5, Arizona Revised Statutes, by adding section 43-1080; relating to _______________.

 Be it enacted by the Legislature of the State of Arizona: Section 1. Title 6, chapter 12, Arizona Revised Statutes, is amended by adding article 3, to read: ARTICLE 3. ILLEGAL ALIEN REMITTANCE FEE START_STATUTE6-1251. Definition of licensee In this article, unless the context otherwise requires, "licensee" means a person that is licensed pursuant to article 1 of this chapter. END_STATUTE START_STATUTE6-1252. Foreign wire transmission fee A. A licensee shall charge a fee from any person that initiates a Foreign WIRE transmission of money. The amount of the assessment is: 1. $25 For each foreign WIRE transmission transaction that is less than $500. 2. $25 plus five percent of the amount that is more than $500 For each foreign WIRE transmission transaction that is $500 or more. B. The Licensee shall pay the fees charged pursuant to subsection A of this section to the department of revenue at the same time the licensee pays the transaction privilege tax under section 42-5064. If the Licensee for any reason does not pay transaction privilege tax, the fee imposed by this section is due and payable to the department of revenue and is delinquent if not paid as provided in section 42-5014, subsection A. C. The department of revenue shall separately account for monies paid under this section and shall deposit, pursuant to sections 35-146 and 35-147, the net revenues in the arizona deportations fund established by section 6-1253. END_STATUTE START_STATUTE6-1253. Arizona deportations fund; exemption; definition A. The Arizona deportations fund is established consisting of monies deposited pursuant to section 6-1252. The state treasurer shall administer the fund. Monies in the fund are subject to legislative appropriation and are exempt from the provisions of section 35-190 relating to lapsing of appropriations. B. Monies in the fund shall be used to provide grants to law enforcement agencies in this state for direct involvement in apprehending an illegal alien as follows: 1. distribution of grant monies shall be provided on confirmation from the United States immigration and customs enforcement or other federal agency that the illegal alien was deported. 2. The grant amount shall be $2,500 for each illegal alien who is apprehended and deported. C. for the purposes of this SECTION, "law enforcement agency" has the same meaning prescribed in section 38-1118. END_STATUTE Sec. 2. Section 43-222, Arizona Revised Statutes, is amended to read: START_STATUTE43-222. Income tax credit review schedule The joint legislative income tax credit review committee shall review the following income tax credits: 1. For years ending in 0 and 5, sections 43-1079.01, 43-1080, 43-1088, 43-1089.04, 43-1167.01 and 43-1175. 2. For years ending in 1 and 6, sections 43-1072.02, 43-1074.02, 43-1075, 43-1076.01, 43-1077, 43-1078, 43-1083, 43-1083.02, 43-1162, 43-1164.03 and 43-1183. 3. For years ending in 2 and 7, sections 43-1073, 43-1082, 43-1085, 43-1086, 43-1089, 43-1089.01, 43-1089.02, 43-1089.03, 43-1164, 43-1165, and 43-1181.  4. For years ending in 3 and 8, sections 43-1074.01, 43-1168, 43-1170 and 43-1178. 5. For years ending in 4 and 9, sections 43-1073.01, 43-1081.01, 43-1083.03, 43-1084, 43-1164.04, 43-1164.05 and 43-1184. END_STATUTE Sec. 3. Title 43, chapter 10, article 5, Arizona Revised Statutes, is amended by adding section 43-1080, to read: START_STATUTE43-1080. Credit for fees paid for foreign wire transmissions of money A credit is allowed against the taxes imposed by this title in the amount paid by the taxpayer for Foreign WIRE transmissions of money pursuant to section 6-1252 during the taxable year. END_STATUTE Sec. 4. Purpose Pursuant to section 43-223, Arizona Revised Statutes, the legislature enacts section 43-1080, Arizona Revised Statutes, as added by this act, to support taxpayers in this state who are subject to the international money wire transfer assessment pursuant to title 6, chapter 12, article 3, Arizona Revised Statutes.  

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 6, chapter 12, Arizona Revised Statutes, is amended by adding article 3, to read:

ARTICLE 3. ILLEGAL ALIEN REMITTANCE FEE

START_STATUTE6-1251. Definition of licensee

In this article, unless the context otherwise requires, "licensee" means a person that is licensed pursuant to article 1 of this chapter. END_STATUTE

START_STATUTE6-1252. Foreign wire transmission fee

A. A licensee shall charge a fee from any person that initiates a Foreign WIRE transmission of money. The amount of the assessment is:

1. $25 For each foreign WIRE transmission transaction that is less than $500.

2. $25 plus five percent of the amount that is more than $500 For each foreign WIRE transmission transaction that is $500 or more.

B. The Licensee shall pay the fees charged pursuant to subsection A of this section to the department of revenue at the same time the licensee pays the transaction privilege tax under section 42-5064. If the Licensee for any reason does not pay transaction privilege tax, the fee imposed by this section is due and payable to the department of revenue and is delinquent if not paid as provided in section 42-5014, subsection A.

C. The department of revenue shall separately account for monies paid under this section and shall deposit, pursuant to sections 35-146 and 35-147, the net revenues in the arizona deportations fund established by section 6-1253. END_STATUTE

START_STATUTE6-1253. Arizona deportations fund; exemption; definition

A. The Arizona deportations fund is established consisting of monies deposited pursuant to section 6-1252. The state treasurer shall administer the fund. Monies in the fund are subject to legislative appropriation and are exempt from the provisions of section 35-190 relating to lapsing of appropriations.

B. Monies in the fund shall be used to provide grants to law enforcement agencies in this state for direct involvement in apprehending an illegal alien as follows:

Sec. 2. Section 43-222, Arizona Revised Statutes, is amended to read:

START_STATUTE43-222. Income tax credit review schedule

The joint legislative income tax credit review committee shall review the following income tax credits:

1. For years ending in 0 and 5, sections 43-1079.01, 43-1080, 43-1088, 43-1089.04, 43-1167.01 and 43-1175.

2. For years ending in 1 and 6, sections 43-1072.02, 43-1074.02, 43-1075, 43-1076.01, 43-1077, 43-1078, 43-1083, 43-1083.02, 43-1162, 43-1164.03 and 43-1183.

3. For years ending in 2 and 7, sections 43-1073, 43-1082, 43-1085, 43-1086, 43-1089, 43-1089.01, 43-1089.02, 43-1089.03, 43-1164, 43-1165, and 43-1181. 

4. For years ending in 3 and 8, sections 43-1074.01, 43-1168, 43-1170 and 43-1178.

5. For years ending in 4 and 9, sections 43-1073.01, 43-1081.01, 43-1083.03, 43-1084, 43-1164.04, 43-1164.05 and 43-1184. END_STATUTE

Sec. 3. Title 43, chapter 10, article 5, Arizona Revised Statutes, is amended by adding section 43-1080, to read:

START_STATUTE43-1080. Credit for fees paid for foreign wire transmissions of money

A credit is allowed against the taxes imposed by this title in the amount paid by the taxpayer for Foreign WIRE transmissions of money pursuant to section 6-1252 during the taxable year. END_STATUTE

Sec. 4. Purpose

Pursuant to section 43-223, Arizona Revised Statutes, the legislature enacts section 43-1080, Arizona Revised Statutes, as added by this act, to support taxpayers in this state who are subject to the international money wire transfer assessment pursuant to title 6, chapter 12, article 3, Arizona Revised Statutes.
