Overview 
Authorizes political subdivision entities to procure insurance and establish self insurance 
programs for direct payment of benefits, losses or claims.   
History 
A political subdivision entity is an entity that is located in this state, created in whole or in 
part by political subdivisions, including instrumentalities of political subdivisions, where a 
majority of the membership of the entity is composed of political subdivisions and whose 
primary purpose is the performance of a government-related service (A.R.S. § 38-711). 
Provisions 
1. Authorizes a political subdivision entity to procure insurance for specified purposes from 
any insurer authorized by the Department of Insurance and Financial Institutions (DIFI). 
(Sec. 2) 
2. Outlines the requirements for a political subdivision entity if the entity establishes a self 
insurance program for the management and administration of a system for direct 
payment of benefits, losses or claims. (Sec. 2) 
3. Specifies that if a trust fund is no longer utilized by a political subdivision entity, the 
funds revert, during that fiscal year, to the general fund of that political subdivision 
entity. (Sec. 2) 
4. Exempts a political subdivision entity from state regulations on insurance, except that 
health, life, accident or disability benefit plans must conform to the benefits required by 
law. (Sec. 2) 
5. Clarifies that this act does not authorize a political subdivision entity to procure 
insurance from any insurer that is not authorized by DIFI. (Sec. 2) 
6. Alters the definition of public agency to include political subdivision entities. (Sec. 1)
