Overview
Alters who can be a designated trustee of an unincorporated townsite and changes filing and
approval requirements related to actions by the trustee.
History
The governing body of an incorporated municipality or the judge of a superior court are the
designated trustee of an unincorporated town until certain conditions are met. When
discharging their duty of trustee, they must execute a bond of $2,000 to be filed and approved
by the Board of Supervisors. After three months of entry, the trustee must have the land
surveyed and platted. The plat must be submitted to the Board of Supervisors and recorded
by the County Recorder. When specified conditions are met and the municipality is the county
seat, the trustee upon petition with consent and advice from the Board of Supervisors can set
apart and deed to the county a site for a courthouse and other county buildings. Undisposed
land in the town under the title of the trustee can be sold at public auction (A.R.S. §§ 9-1101,
9-1102, 9-1103, 9-112).
