SENATE BILL 1228

 

 

 

 

AN ACT

 

establishing a moratorium on new residential housing development regulations.

 Be it enacted by the Legislature of the State of Arizona: Section 1. New residential development standards; moratorium; exemption; delayed repeal A. Notwithstanding any other law, beginning on the effective date of this act through June 30, 2028, the governing body of a municipality may not adopt or enforce a new regulation, standard, stipulation or other requirement on the development of a new single-family home, subdivision plat or planned area development unless the new regulation, standard, stipulation or other requirement is designed to do either of the following: 1. Protect public health and safety. 2. Reduce the cost of construction of new housing developments. B. This section is repealed from and after June 30, 2028. Sec. 2. Legislative findings The legislature finds: 1. That Arizona is currently facing a housing shortage and affordability crisis. 2. That building new housing is a priority of this state. 3. That housing regulations that do not demonstrate a public health and safety benefit are contributing to this state's housing shortage and affordability crisis. 

Be it enacted by the Legislature of the State of Arizona:

A. Sec. 2. Legislative findings

The legislature finds:

1. That Arizona is currently facing a housing shortage and affordability crisis.

2. That building new housing is a priority of this state.

3. That housing regulations that do not demonstrate a public health and safety benefit are contributing to this state's housing shortage and affordability crisis.
