CTEDs; state universities; intergovernmental agreements 
Purpose 
Authorizes a career technical education district (CTED) and a public university to enter 
into an intergovernmental agreement (IGA) to provide administrative, operational and educational 
services or facilities if equivalent courses or programs are not available through an existing IGA 
between the CTED and another entity. Applies the IGA and funding calculation requirements for 
a CTED that enters into an IGA with a community college district (CCD) to a CTED that enters 
into an IGA with a public university. 
Background 
CTEDs are responsible for providing career and technical education (CTE) preparation 
programs designed to prepare students for advanced CTE or entry into the workforce. A CTED 
and CCD may enter into agreements to provide for administrative, operational and educational 
services and facilities. Any agreement between a CTED governing board and another CTED, 
school district, charter school or CCD must be in the form of an IGA or other written contract, 
which must completely and accurately specify: 1) the financial provisions of the agreement and 
the format for billing of all services; 2) the accountability provisions of the agreement; 3) the 
responsibilities of party included in the agreement; 4) the type and quality of the instruction that 
will be provided; 5) the transportation services that will be provided and the manner in which 
transportation costs will be paid; 6) the amount that the CTED will contribute to a course and 
amount of support required from the other entity; 7) that the services provided be proportionally 
calculated in the cost of delivering the service; 8) that the payment for services will not exceed the 
cost of services provided; and 9) an itemized listing of other goods and services provided to the 
CTED and that are paid for from CTED funding. 
A student enrolled in a CTE program or course provided by a community college generates 
an average daily membership (ADM) of 0.25 for the accumulation of every three community 
college credits for which the student is enrolled for CTE courses. The sum of the ADM for a 
student enrolled in a school district or charter school and a CTE program or course provided by a 
community college may not exceed 1.75. A school district and CTED must determine the 
apportionment of ADM for students, except that the apportioned amount may not exceed 1.0 ADM 
for either entity (A.R.S. § 15-393).  
The Arizona Board of Regents (ABOR) exercises the powers necessary for the effective 
governance and administration of the institutions under its control. ABOR may delegate, to 
ABOR's committees, the public university presidents or their designees or other entities under 
ABOR's control, parts of its authority for the administration and governance of its institutions, 
including the authority to establish curricula and designate public university courses that will best 
serve the interests of Arizona (A.R.S. § 15-1626).  FACT SHEET

There is no anticipated fiscal impact to the state General Fund associated with this 
legislation. 
Provisions 
1. Stipulates that a CTED may enter into an IGA with a public university for the provision of 
administrative, operational and educational services and facilities if equivalent courses or 
programs are not available through an existing IGA between the CTED and a CCD, a school 
district, a charter school or another CTED. 
2. Applies IGA requirements for a CTED that enters an IGA with another CCD, school district, 
charter school or another CTED to a CTED that enters an IGA with a public university. 
3. Applies the funding calculation requirements for a CTE course or program provided by a CCD 
to a CTE course provided by a public university. 
4. Requires ABOR to enter into an IGA with a CTED governing board to provide administrative, 
operational and educational services and facilities by a public university if the agreement, in 
ABOR's judgement, will serve the interests of Arizona. 
5. Allows ABOR to delegate the requirement to enter IGAs with a CTED governing board to 
ABOR's committees, the public university presidents or their designees or any other entity 
under ABOR's control. 
6. Makes technical changes. 
7. Becomes effective on the general effective date.
