Repeals session law language that requires appropriated monies to revert to the state General Fund (GF) if a judge rules that the monies may not be distributed to a nonprofit that operates the rodeo. History The FY 2024 Budget appropriated $15,300,000 from the state GF in FY 2024 to a nonprofit volunteer organization that operates a rodeo at the Yavapai County fairgrounds. The FY 2025 Budget exempted the appropriation from lapsing and additionally stated that if a court of competent jurisdiction rules that the appropriated monies may not be distributed to the nonprofit, the monies must revert to the state GF within 60 days of the judgement. Provisions 1. Strikes language from Laws 2023, Ch. 133 § 118 that appropriated monies to a nonprofit volunteer organization that operates a rodeo at the Yavapai County fairgrounds. (Sec. 1) 2. Repeals Laws 2024, Ch. 209 § 119 that required monies appropriated to the nonprofit organization to revert to the state GF if a court with jurisdiction ruled the monies may not be distributed to the nonprofit. (Sec. 2) 3. Appropriates $15,300,000 from the state GF in FY 2026 to the City of Prescott to renovate and repair the rodeo grounds owned by the City and exempts the appropriation from lapsing. (Sec. 3) 4. Contains a conditional enactment clause stating that this Act does not become effective unless a court of competent jurisdiction rules that the monies appropriated pursuant to Laws 2023, Ch. 133 § 118 may not be distributed to a nonprofit volunteer organization that operates the rodeo and the judgment of that court becomes final. (Sec. 4) 5. Repeals this Act as of the date a court of competent jurisdiction rules the monies appropriated pursuant to Laws 2023, Ch. 133 may be distributed to a nonprofit volunteer organization that operates the rodeo and the judgement becomes final. Requires the Attorney General to notify the Director of Legislative Council in writing not more than three business days after either: a) a court of competent jurisdiction rules the appropriated monies may not be distributed to a nonprofit volunteer organization that operates the rodeo; or b) a court of competent jurisdiction rules the appropriated monies may be distributed to a nonprofit volunteer organization that operates the rodeo.
