Assigned to ED AS PASSED BY COMMITTEE ARIZONA STATE SENATE Fifty-Seventh Legislature, First Regular Session AMENDED FACT SHEET FOR S.B. 1693 students; interscholastic activities; eligibility; costs Purpose Requires a public school to allow eligible private school students to try out for interscholastic activities on behalf of the public school. Prohibits a public school from charging a private school student an interscholastic activity participation fee that exceeds the student's pro rata share of program costs. Background A child who is homeschooled and resides within the attendance area of a public school must be allowed to try out for interscholastic activities on behalf of the school in the same manner as a student enrolled in that school. Policies for homeschooled students must be consistent with policies for enrolled students. The person providing the primary instruction of a homeschooled child must verify in writing whether the student is receiving a passing grade in each course of subject and maintaining satisfactory progress towards advancement or promotion. A homeschooled child is ineligible to participate in activities for the remainder of a school year during which the child was enrolled in a school (A.R.S. § 15-802.01). A private school is a nonpublic institution, other than the child's home, where academic instruction is provided for at least the same number of days and hours each year as a public school (A.R.S. § 15-802). There is no anticipated fiscal impact to the state General Fund associated with this legislation. Provisions 1. Requires a private school student who resides in the attendance area of a public school to be allowed to try out for interscholastic activities on behalf of the public school in the same manner as a student who is enrolled in the public school. 2. Requires the policies and requirements for private school students relating to registration, age eligibility, fees, insurance, transportation, physical condition, qualifications, responsibilities, event schedules, standards of behavior and performance participating in or trying out for interscholastic activities to be consistent with the policies and requirements established for students enrolled in the public school. 3. Requires the parent of a private school student who tries out for an interscholastic activity on behalf of a public school to submit written verification to the public school that the student is: a) receiving a passing grade in each course or subject in which the student is being taught; and b) maintaining satisfactory progress towards advancement in promotion. Determines that a private school student who was previously enrolled in a school district, charter school or different private school is ineligible to participate in interscholastic activities for the remainder of the school year during which the student was previously enrolled. 5. Prohibits a school district from contracting with a private entity that supervises interscholastic activities if the private entity prohibits private school students from participating in interscholastic activities at public, private or charter schools. 6. Prohibits a public school from charging a private school student a participation fee that exceeds the student's pro rata share of the program costs for the interscholastic activity. 7. Specifies that the pro rata share for a private school student who participates in interscholastic activity on behalf of a public school is calculated by dividing the total amount that the public school has budgeted for the interscholastic activity by the total number of students who are participating in the interscholastic activity during the budget year. 8. Specifies that the requirements relating to participation fees for private school students who participate in a public school's interscholastic activity do not prevent a public school from requiring private school students to pay for interscholastic activity expenses if the public school requires all participating students, including students who are enrolled in the public school, to pay the expenses. 9. Defines private school student as a student who resides within the attendance area of a public school and who is educated in a private school that does not offer the interscholastic activity for which the student is trying out. 10. Becomes effective on the general effective date. Amendments Adopted by Committee • Removes homeschool students from the requirements relating to participation fees for interscholastic activities.
