Manuel Perez FEBRUARY 27, 2009 An act to add Article 2.5 (commencing with Section 11570) to Chapter 6 of Part 1 of Division 3 of Title 2 of the Government Code, relating to boards and commissions. LEGISLATIVE COUNSEL'S DIGEST AB 1501, as introduced, V. Manuel Perez. Boards and commission: salaries full time. Existing law specified the salaries of certain members of various state boards and commissions. This bill would require the salary of a board member, as defined, that is set by statute to be based on the board member serving full time and would require, if a board member does not work full time in any given month, to prorate the salary of that board member to the actual hours worked while serving as a board member. The bill would exclude from these requirements a board member who is paid a salary on or after January 1, 2010, of less than $100,000. The bill would require the Department of Personnel Administration to adopt regulations for determining which activities constitute service as a board member and the minimum number of hours required to deem a board member to be serving full time, which would be prohibited from being less than 160 hours per month. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Article 2.5 (commencing with Section 11570) is added to Chapter 6 of Part 1 of Division 3 of Title 2 of the Government Code, to read: Article 2.5. Board and Commisions: Full-Time Service 11570. (a) Notwithstanding any other provision of law, including, but not limited to, Article 1 (commencing with Section 11550) and Article 2 (commencing with Section 11565), and including Section 11568, the salary of any member of a board, commission, committee, or similarly constituted body created by executive order or statute shall be subject to the requirements of this article. (b) For purposes of this article "board member" means a member of a board, commission, committee, or similarly constituted body created by executive order or statute, except as provided in subdivision (c). (c) This article does not apply to a board member who is paid an annual salary on or after January 1, 2010, of less than one hundred thousand dollars ($100,000). 11571. The salary of a board member set by statute shall be based on the board member serving full time as a board member and if the board member does not work full time in any given month, the salary of that board member shall be prorated to the actual hours worked while serving as a board member. 11572. The Department of Personnel Administration shall adopt regulations for determining which activities constitute service as a board member and the minimum number of hours required to deem a board member as serving full time, which shall be no less than 160 hours per month. 11573. If any salary determined pursuant to this article is greater than the salary which the board member received on January 1, 2010, the board member shall receive the higher amount on and after February 1, 2011.
