 BILL NUMBER: SB 1144INTRODUCED BILL TEXT INTRODUCED BY Senator Wyland FEBRUARY 18, 2010 An act to amend Section 33308.5 of the Education Code, relating to education. LEGISLATIVE COUNSEL'S DIGEST SB 1144, as introduced, Wyland. Education. Existing law requires that program guidelines issued by the State Department of Education be designed to serve as a model or example and prohibits those guidelines from being prescriptive. Existing law requires the Superintendent of Public Instruction to review the guidelines before they are issued to local educational agencies. This bill would make technical, nonsubstantive changes in these provisions. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 33308.5 of the Education Code is amended to read: 33308.5. (a) Program guidelines issued by the  State Department of Education   department  shall be designed to serve as a model or example, and shall not be prescriptive. Program guidelines issued by the department shall include written notification that the guidelines are merely exemplary, and that compliance with the guidelines is not mandatory. (b) The Superintendent  of Public Instruction  shall review all program guidelines prepared by the  State Department of Education prior to   department before  issuance to local  education   educational  agencies. The  superintendent   Superintendent  shall approve the proposed guidelines only if he or she determines that all of the following conditions are met: (1) The guidelines are necessary. (2) The department has the authority to issue the guidelines. (3) The guidelines are clear and appropriately referenced to, and consistent with, existing statutes and regulations.
