LEGISLATIVE COUNSEL'S DIGEST SB 1194, as introduced, Hollingsworth. Air districts: residential wood-burning devices. Existing law designates air pollution control districts and air quality management districts as having the primary responsibility for the control of air pollution from all sources other than vehicular sources. This bill would prohibit a district from adopting or implementing a rule or regulation that prohibits the installation of a wood-burning fireplace, wood-burning heater, or wood-burning stove in a new or existing residential structure. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 41814 is added to the Health and Safety Code, to read: 41814. (a) A district shall not adopt or implement a rule or regulation that prohibits the installation of a wood-burning fireplace, wood-burning heater, or wood-burning stove in a new or existing residential structure. (b) This section does not limit the authority of a district to regulate the operation or use of a wood-burning fireplace, wood-burning heater, or wood-burning stove in a new or existing residential structure, including, but not limited to, requiring that there be no burning of wood on certain days of the year.
