LEGISLATIVE COUNSEL'S DIGEST AB 1143, as introduced, Dickinson. Director of General Services: authority to enter into a lease, lease-purchase agreement, or a lease with an option to purchase a build-to-suit facility. Existing law authorizes the Director of General Services to hire, lease, lease-purchase, or lease with the option to purchase any real or personal property for the use of any state agency. This bill would authorize the director, with the consent of the State Board of Equalization, to enter into a lease, lease-purchase agreement, or a lease with an option to purchase for a build-to-suit facility, for the relocation of the State Board of Equalization in the Sacramento region. This bill would require the Department of General Services (department) to develop the terms and conditions of any agreements or leases authorized by this provision and to provide them to the Department of Finance for review and approval prior to soliciting bids. This bill would require the department to notify the chairpersons of the fiscal committees of the Legislature and the Joint Legislative Budget Committee, or his or her designee, of the terms and conditions of the agreement or lease at least 30 days prior to executing the agreement for a lease, lease-purchase, or lease with an option to purchase a build-to-suit of real property authorized by this provision. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 14669.16 is added to the Government Code, to read: 14669.16. (a) Notwithstanding any other law, the Director of General Services, with the consent of the State Board of Equalization, may enter into a lease, lease-purchase agreement, or a lease with an option to purchase for a build-to-suit facility, for the relocation of the State Board of Equalization in the Sacramento region. The director may enter into one or more agreements or leases for the purposes of providing usable office and related space in the Sacramento region in order to consolidate various departments of the State Board of Equalization into a single location. (b) (1) The Department of General Services shall develop the terms and conditions of the agreements or leases authorized by this section, and provide them to the Department of Finance for review and approval prior to soliciting bids. The department shall obtain approval from the Department of Finance prior to execution of any agreement or lease. (2) The department shall notify the chairpersons of the fiscal committees of the Legislature and the Joint Legislative Budget Committee, or his or her designee, of the terms and conditions of the agreement or lease at least 30 days prior to executing the agreement for a lease, lease-purchase, or lease with an option to purchase for a build-to-suit of real property authorized by this section. The department may proceed with the agreement or lease 30 days following the date the department gave notice to the chairpersons. (c) The department shall be reimbursed for any reasonable cost or expense incurred for the transactions described in this section.
