 BILL NUMBER: AB 1174AMENDED BILL TEXT AMENDED IN ASSEMBLY MARCH 10, 2011 INTRODUCED BY Assembly Member Furutani FEBRUARY 18, 2011 An act to amend Section  33534   32210  of the Education Code, relating to pupil  curriculum   safety  . LEGISLATIVE COUNSEL'S DIGEST AB 1174, as amended, Furutani.  Curriculum Development and Supplemental Materials Commission.   School safety: willful disturbance of public school activities.   (1) Existing law provides that any person who willfully disturbs any public school or any public school meeting is guilty of a misdemeanor and subject to a fine of not more than $500.   This bill would additionally provide that a person who willfully disturbs a public school activity, as defined to include, but not necessarily be limited to, the arrival and departure of pupils to and from public school grounds during school hours as defined, is guilty of a misdemeanor and subject to a fine of not more than $500. Because this bill would expand the scope of an existing crime, it would impose a state-mandated local program.   (2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.   This bill would provide that no reimbursement is required by this act for a specified reason.   Existing law establishes the Curriculum Development and Supplemental Materials Commission in state government and requires the Superintendent of Public Instruction or his representative to serve as executive secretary to the commission.   This bill would make technical, nonsubstantive changes to that provision.  Vote: majority. Appropriation: no. Fiscal committee:  no   yes  . State-mandated local program:  no   yes  . THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 32210 of the   Education Code   is amended to read:  32210.  Any   (a)     A  person who willfully disturbs  any   a  public school  , a   public school activity,  or  any   a  public school meeting is guilty of a misdemeanor, and shall be punished by a fine of not more than five hundred dollars ($500).  (b) As used in this section, "public school activity" includes, but is not necessarily limited to, the arrival and departure of pupils to and from public school grounds during school hours as defined in subdivision (e) of Section 32211.   SEC. 2.   No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.   SECTION 1.   Section 33534 of the Education Code is amended to read: 33534. The Superintendent of Public Instruction, or his or her representative, shall serve as executive secretary to the commission.
