LEGISLATIVE COUNSEL'S DIGEST AB 1860, as introduced, Fletcher. Water: regional water quality control boards. The Porter-Cologne Water Quality Control Act provides for the regional administration of water quality laws and, for that purpose, divides the state into 9 regions with prescribed boundaries. The act establishes a California regional water quality control board within each region whose activities are overseen by the State Water Resources Control Board. Existing law requires each regional board to formulate and adopt water quality control plans for all areas within the region, as specified. Under existing law a water quality control plan, or a revision of the plan, adopted by a regional board, shall not become effective unless it is approved by the state board, as specified. This bill would make technical, nonsubstantive changes in this provision. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 13245 of the Water Code is amended to read: 13245. A water quality control plan, or a revisionthereofof the plan adopted by a regional board, shall not become effective unlessand untilit is approved by the state board. The state board may approvesuchthe plan, or return it to the regional board for further consideration and resubmission to the state board. Upon resubmission the state board may either approve or, after a public hearing in the affected region, revise and approvesuchthe plan.
