LEGISLATIVE COUNSEL'S DIGEST AB 670, as amended, Block. Public postsecondary education: California State University: admissions. Existing law establishes the California State University as one of the segments of public postsecondary education in the state. The university includes 25 specified campuses and is administered by a board, known as the Trustees of the California State University. This bill would require the trustees to ensure that campuses meet specific requirements with respect to appeal procedures for a denial of admission. The Donahoe Higher Education Act sets forth, among other things, the missions and functions of California's public and independent segments of higher education, and their respective institutions of higher education. The act states the intent of the Legislature regarding the opportunity to enroll in an institution of higher education. The bill would make technical, nonsubstantive changes to that statement. Vote: majority. Appropriation: no. Fiscal committee: no yes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 89030.7 is added to the Education Code , to read: 89030.7. With respect to denial of admission for an applicant, the Trustees of the California State University shall ensure for each campus of the California State University all of the following: (a) Appeal procedures that clearly set forth the basis or bases upon which an applicant may appeal. (b) Appeal procedures that include at least 15 days from the date of denial of admission notification to appeal. (c) The campus posts on its Internet Web site information detailing the procedures for appealing a denial of admission, the timeframe for appeal, and the criteria for appeal. (d) The campus includes in a denial of admission notification to a student information detailing appeal procedures. The notification shall include the time for appeal, the criteria for appeal, and the contact information for the campus office to which an appeal is submitted. SECTION 1. Section 66201 of the Education Code is amended to read: 66201. (a) It is the intent of the Legislature that every resident of California who has the capacity and motivation to benefit from higher education should have the opportunity to enroll in an institution of higher education. Once enrolled, each individual should have the opportunity to continue as long and as far as his or her capacity and motivation, as indicated by academic performance and commitment to educational advancement, will lead him or her to meet academic standards and institutional requirements. (b) The Legislature hereby reaffirms the commitment of the State of California to provide an appropriate place in California public higher education for every student who is willing and able to benefit from attendance.
