LEGISLATIVE COUNSEL'S DIGEST AB 737, as introduced, Huber. Local agencies: benefit assessments. Existing law authorizes local agencies to levy a benefit assessment pursuant to the Benefit Assessment Act of 1982 to finance specified costs. This bill would authorize any local agency levying a benefit assessment pursuant to this act to bring an action to determine the validity of the assessment pursuant to specified provisions of existing law relating to validating proceedings. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 54712 is added to the Government Code, to read: 54712. Any local agency levying a benefit assessment pursuant to this chapter may bring an action to determine the validity of the assessment pursuant to Chapter 9 (commencing with Section 860) of Title 10 of Part 2 of the Code of Civil Procedure.
