LEGISLATIVE COUNSEL'S DIGEST AB 747, as amended, Huber. Pupil instruction: online programs.  Existing law states the intent of the Legislature to enact legislation to implement specified policy objectives regarding distance learning, which is defined as instruction in which the pupil and instructor are in different locations and interact through the use of computer and communications technology.   This bill would define an online offsite classroom instructional program to mean an instructional program in which a pupil receives online instruction from a teacher who may be onsite or offsite, subject to certain requirements if the teacher is offsite.   Existing law defines an asynchronous interactive instructional program as a program in which a pupil and teacher interact using online resources, including, but not limited to, discussion boards, Internet Web sites, and e-mail.   This bill would make technical, nonsubstantive changes to this definition.  Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 51866 is added to the   Education Code   , to read:   51866. "Online offsite classroom instructional program" means an instructional program, separate from independent study, in which a pupil receives online instruction from a teacher who may be onsite or offsite, and if the teacher is offsite, instruction is provided to pupils through video conferencing technology that supports two-way communication.   SECTION 1.   Section 51705 of the Education Code is amended to read: 51705. For purposes of this article, the following terms have the following meanings: (a) "Asynchronous interactive instructional program" means a program in which a pupil and teacher interact using online resources, including, but not limited to, discussion boards, Internet Web sites, and e-mail. However, the pupil and teacher need not be online at the same time. (b) "Internet" means the global information system that is logically linked together by a globally unique address space based on the Internet Protocol (IP), or its subsequent extensions, and that is able to support communications using the Transmission Control Protocol/Internet Protocol (TCP/IP) suite, or provides, uses, or makes accessible, either publicly or privately, high-level services layered on the communications and related infrastructure described in this subdivision.
