LEGISLATIVE COUNSEL'S DIGEST AB 763, as introduced, Bill Berryhill. Department of Water Resources. Existing law establishes in the Natural Resources Agency the Department of Water Resources, which is under the control of the Director of Water Resources. Existing law provides for the appointment of the director by the Governor, subject to confirmation by the Senate. This bill would delete an obsolete reference from, and make technical, nonsubstantive changes to, the provisions establishing the department and providing for the appointment of the director. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 120 of the Water Code is amended to read: 120. (a) There is in the Natural Resources Agency the Department of Water Resources, which is under the control of an executive officer known as the Director of Water Resources.The(b) The directorisshall be appointed by the Governor andholdsshall hold office at the pleasure of the Governor. The appointment of the director is subject to confirmation by the Senate at the next regular or special session of the Legislature, and the refusal or failure of the Senate to confirm the appointment shall create a vacancy in the office.The(c) The director shall receive an annual salary as provided for by Chapter 6 (commencing with Section 11550) of Part 1 of Division 3 of Title 2 of the Government Codeand he is a member of the Governor's Council.
