An act relating to the payment of claims against the state, making an appropriation therefor, and declaring the urgency thereof, to take effect immediately. Existing law authorizes a procedure for the state to pay claims against the state. This bill would appropriate funds in prescribed amounts for the payment of certain claims against the state. This bill would declare that it is to take effect immediately as an urgency statute. The Urban Water Management Planning Act requires an urban water supplier to prepare and adopt an urban water management plan that identifies and quantifies the existing and planned sources of water available to the water supplier's service area, based on specified factors. The act states the intent of the Legislature, in enacting the act, to permit levels of water management planning commensurate with the number of customers served and the volume of water supplied. This bill would make technical, nonsubstantive changes to that intent provision. Vote: majority 2/3 . Appropriation: no yes . Fiscal committee: no yes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. The sum of one million three hundred thousand dollars ($1,300,000) is hereby appropriated from the General Fund to the Department of Justice to pay the settlements and accumulated interest in Darling v. Douglas, United States District Court, Northern District of California, Case No. 4:09-cv-03798-SBA. Any funds appropriated in excess of the amount required for the payment of this claim shall revert to the General Fund. SEC. 2. The sum of one million three hundred thousand dollars ($1,300,000) is hereby appropriated from the Federal Trust Fund to the Department of Justice to pay the settlements and accumulated interest in Darling v. Douglas, United States District Court, Northern District of California, Case No. 4:09-cv-03798-SBA. Any funds appropriated in excess of the amount required for the payment of this claim shall revert to the Federal Trust Fund. SEC. 3. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are: In order to pay claims against the state and end hardship to claimants as quickly as possible, it is necessary that this bill go into immediate effect. SECTION 1. Section 10630 of the Water Code is amended to read: 10630. It is the intent of the Legislature, in enacting this part, to permit levels of water management planning commensurate with the number of customers served and the volume of water supplied.
