 BILL NUMBER: AB 1092INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Levine FEBRUARY 22, 2013 An act to add Section 22511.2 to the Vehicle Code, relating to electric charge stations. LEGISLATIVE COUNSEL'S DIGEST AB 1092, as introduced, Levine. Electric charge stations: new construction projects. Existing law allows a local authority and a person in lawful possession of an offstreet parking facility to designate spaces for charging an electric vehicle. This bill would require a new construction project with 4 or more offstreet parking spaces to include one electric vehicle charge station per every 4 offstreet parking spaces included in the project. By imposing new duties upon local entities in the approval of construction projects, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 22511.2 is added to the Vehicle Code, to read: 22511.2. (a) A local authority shall require that a construction project with four or more offstreet parking spaces include one electric vehicle charge station per every four offstreet parking spaces included in the project. (b) This section applies only to construction projects for which a building permit is issued on or after January 1, 2014. SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
