BILL NUMBER: AB 570INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Jones-Sawyer FEBRUARY 20, 2013 An act to amend Section 46170 of the Education Code, relating to school attendance. LEGISLATIVE COUNSEL'S DIGEST AB 570, as introduced, Jones-Sawyer. Continuation schools: minutes of attendance. Existing law requires the governing board of each school district to fix the length of the schoolday for the several grades and classes of the schools maintained by the district, subject to the provisions as prescribed. Under existing law, in continuation high schools and continuation education classes, a day of attendance is 180 minutes of attendance, but no pupil is credited with more than 15 hours of attendance per school week, proportionately reduced for those school weeks having weekday holidays on which classes are not held. This bill would change the requirement of 180 minutes to 240 minutes for a day of attendance. Because this bill creates new duties for local educational agencies, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 46170 of the Education Code is amended to read: 46170. In continuation high schools and continuation education classes, a day of attendance is180240 minutes of attendance , but no pupil shall be credited with more than 15 hours of attendance per school week, proportionately reduced for those school weeks having weekday holidays on which classes are not held. SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
