 BILL NUMBER: AB 647INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Chesbro FEBRUARY 21, 2013 An act to amend Section 23789 of the Business and Professions Code, relating to alcoholic beverages. LEGISLATIVE COUNSEL'S DIGEST AB 647, as introduced, Chesbro. The Alcoholic Beverage Control Act. The Alcoholic Beverage Control Act, administered by the Department of Alcoholic Beverage Control, prescribes requirements for licenses for the manufacture, distribution, and sale of alcoholic beverages. The act specifically authorizes the department to refuse the issuance, other than renewal or ownership transfer, of any retail license for premises located within the immediate vicinity of a church or hospital. This bill would make technical, nonsubstantive changes in these provisions. Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 23789 of the Business and Professions Code is amended to read: 23789. (a) The department is specifically authorized to refuse the issuance, other than renewal or ownership transfer, of any retail license for premises located within the immediate vicinity of  churches and hospitals   a church or hospital  . (b) The department is specifically authorized to refuse the issuance, other than renewal or ownership transfer, of any retail license for premises located within at least 600 feet of  schools and public playgrounds   a school, public playground,  or nonprofit youth  facilities,   facility,  including, but not limited to,  facilities   a facility  serving Girl Scouts, Boy Scouts, or Campfire Girls. This distance shall be measured pursuant to rules of the department.
