LEGISLATIVE COUNSEL'S DIGEST SB 660, as amended, Hancock. Career technical education: funding. Existing law provides funding for various career technical education programs, including regional occupational centers and programs, specialized secondary programs, partnership academies, and agricultural career technical education programs. This bill would, for the  2015-16 fiscal year and each subsequent   2013-14  fiscal year, require the Superintendent of Public Instruction, using funds appropriated in the annual Budget Act for regional occupational centers and programs, to apportion from the amounts provided in the annual Budget Act for those purposes an amount to each county office of education  , school district, and joint powers agency based on   in  the same relative proportion of funding that  each   the  county office of education, school  district   districts , and joint powers  agency   agencies within that county  received in the 2012-13 fiscal year for those purposes.  The bill would, for the 2014   -15  fiscal year and each fiscal year thereafter, require the allocation made to those entities to be adjusted annually for increases in cost of living, as specified.  The bill would authorize local educational agencies that operate career technical education programs to form into  regions for these purposes   a Regional Career Technical Education Collaborative (RCTEC) to share in the cost of developing and maintaining a career technical education program based upon curricula aligned with the California Career Technical Education Standards and Common Core State Standards,  and would require the apportioned funds to be expended only to ensure the development and maintenance of a high-quality career technical education program.  The bill would require an RCTEC to comply with specified requirements as a condition of receiving funds, including, among others, certifying to the State Department of Education that each course within a sequence is aligned to the California Career Technical Education Standards. The bill would require the Superintendent to incorporate various factors and quality indicators into the accountability measures for regional occupational centers and programs and other related programs, and would require the Superintendent to develop an evaluation instrument to evaluate the programs within each RCTEC commencing with the 2015-16 school year.  Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 52334.7 is added to the   Education Code   , to read:   52334.7. (a) For the 2013-14 fiscal year: (1) Notwithstanding Section 42605 or any other law, from funds appropriated in Items 6110-105-0001, 6110-122-0001, 6110-166-0001, and 6110-167-001 of Section 2.00 of the annual Budget Act, the Superintendent shall apportion an amount to each county office of education in the same relative proportion of funding that the county office of education, school districts, and joint powers agencies within that county received from funds appropriated for those items in the 2012-13 fiscal year. (2) From the funds described in paragraph (1), each county office of education shall allocate to regional occupational centers and programs in accordance with Section 52321, school districts, and county offices of education a proportion of these funds in the same relative proportion of funding that these entities received in the 2012-13 fiscal year. (b) For the 2014-15 fiscal year and each fiscal year thereafter, the allocation made to each regional occupational center and program, school district, and county office of education shall be adjusted annually for increases in costs of living by adding the product of the prior year allocation and the index described in paragraph (2) of subdivision (b) of Section 42238.1 to the prior year allocation. (c) (1) (A) Local educational agencies that operate career technical education programs may form into a Regional Career Technical Education Collaborative (RCTEC) for purposes of this paragraph. (B) Notwithstanding any other law, within an RCTEC formed pursuant to subparagraph (A), two or more of the following entities may enter into an agreement to use funding received from Items 6110-105-0001, 6110-122-0001, 6110-166-0001, and 6110-167-0001 of Section 2.00 of the annual Budget Act to share in the cost of developing and maintaining a career technical education program based upon curricula aligned with California Career Technical Education Standards and Common Core State Standards: (i) The governing board, or its designee, of a regional occupational center or program. (ii) The chair or designee of a schoolsite Agricultural Advisory Committee. (iii) A site director of a California partnership academy. (iv) The superintendent or governing board of a school district, or its appointee. (C) The agreement formed pursuant to subparagraph (B) shall remain in effect for one year, and shall be renewable annually thereafter with the consent of the parties to the agreement. (2) Notwithstanding any other law, funds allocated pursuant to this section and funds subject to an agreement pursuant to subparagraph (B) may be expended only to ensure the development and maintenance of a high-quality career technical education program. (3) In the absence of an agreement pursuant to subparagraph (B), funds appropriated in Items 6110-122-0001, 6110-166-0001, and 6110-167-0001 of Section 2.00 of the annual Budget Act may be expended only for the purposes of the programs for which they were appropriated. (d) (1) As a condition of receipt of funds pursuant to this section, the governing board of each regional occupational center or program, in collaboration with individuals representing partner school districts, California partnership academies, agricultural career technical education programs, and other career technical education programs within each RCTEC, shall do all of the following: (A) Develop a plan for establishing a sequence of courses by July 1, 2015. This plan shall not be in conflict with the plan developed pursuant to Section 52302, and, to the extent it is appropriate, shall be based on that plan and shall update that plan. (B) Certify to the department by September 1, 2016, that each sequence of courses specified in the plan required by this subdivision has been developed. (C) Report each new sequence of courses and each modification to existing sequences to the department no later than September 1 of the fiscal year in which the changes are implemented. (D) Certify to the department that each course within a sequence is aligned to the California Career Technical Education Standards. (E) Certify to the department that each course, where appropriate, is aligned to the Common Core State Standards. (2) Programs receiving funds pursuant to this section shall collect and report data as required by the department to prepare and update an accountability measure as provided in existing statute and in subdivision (e). (e) (1) To determine the quality and effectiveness of a career technical education course of study or sequence of career technical education courses funded pursuant to subdivisions (a) and (b), the Superintendent shall incorporate into the accountability measures for regional occupational centers and programs, agricultural career technical education programs, partnership academies, and specialized secondary education programs a uniform accountability metric based on any career-ready standards adopted pursuant to the federal Elementary and Secondary Education Act (20 U.S.C. Sec. 6301 et seq.) and the following program quality indicators in the California State Plan for Career Technical Education: (A) Leadership at all levels. (B) High-quality curriculum and instruction aligned with state standards. (C) Career exploration and guidance. (D) Pupil support and leadership development. (E) Industry partnerships and advisory committees. (F) System alignment and coherence, including postsecondary education institution involvement. (G) After school, extended day, and out-of-school opportunities. (H) Reflection of labor market demands and provision of current equipment. (I) Skilled faculty and professional development. (J) Career technical education outreach and communication. (K) Data-based pupil evaluation, accountability, and continuous improvement. (2) In addition to the indicators listed in paragraph (1), the accountability measures shall include the rates at which pupils complete a course of study or sequence of career technical education courses that provide the skills and knowledge necessary to attain entry-level employment in business or industry, or to pursue postsecondary education after those pupils graduate from high school. The pupil data shall include, but are not necessarily limited to, all of the following: (A) The number of pupils completing high school. (B) The number of pupils earning an industry-recognized certification or licensure or other measures of technical skill attainment. (C) The number of pupils completing career technical education courses and completing a career technical education program of study, consisting of a sequence of two or more career technical education courses. (D) The number of pupils employed and the types of businesses in which they are employed. (E) The number of pupils enrolled in postsecondary education or apprenticeship programs, or serving in the Armed Forces. (3) The accountability measures shall also include data on the industry certifications available for pupils to complete. (f) The Superintendent shall develop an evaluation instrument to evaluate the programs within each RCTEC commencing with the 2015-16 school year, and annually thereafter. (1) The evaluation shall be based on the uniform metric developed pursuant to subdivision (e) and may be based on the existing evaluation instrument described in the California County Superintendents Educational Services Association Course of Study document. (2) The Superintendent shall collaborate with stakeholders including, but not limited to, representatives from: (A) Regional occupational centers and programs. (B) California partnership academies. (C) Agricultural career technical education programs. (D) County offices of education. (E) The California School Boards Association. (F) The Association of California School Administrators. (G) The California Teachers Association. (H) The California Manufacturers and Technology Association. (I) The Building Trades Association. (3) The completed evaluation instrument shall be reviewed by an independent local review council comprised of representatives from the following: (A) A county office of education. (B) A school district. (C) An industry advisory committee, advisory board, or member of local business and industry. (D) The Regional Occupational Centers and Programs Joint Powers Authority, where applicable. (E) Postsecondary education. (F) A local workforce investment board. (4) The evaluation instrument shall be submitted to the department for review.   SECTION 1.   Section 52334.7 is added to the Education Code, to read: 52334.7. (a) Notwithstanding Section 42605 or any other law, for the 2015-16 fiscal year and each subsequent fiscal year, from funds appropriated in Items 6110-105-0001, 6110-122-0001, 6110-166-0001, and 6110-167-0001 of Section 2.00 of the annual Budget Act, the Superintendent shall apportion from the amounts provided in the annual Budget Act for those items an amount to each county office of education, school district, and joint powers agency based on the same relative proportion that each county office of education, school district, and joint powers agency received from each of those items in the 2012-13 fiscal year.
