 BILL NUMBER: AB 1757AMENDED BILL TEXT AMENDED IN ASSEMBLY MARCH 17, 2016 INTRODUCED BY Assembly Member Waldron FEBRUARY 2, 2016  An act to amend Section 96.7 of the Revenue and Taxation Code, relating to local government finance.   An act to amend Section 20351 of the Public Contract Code, a   nd to amend Sections 125107 and 125220 of the Public Utilities Code, relating to transit.  LEGISLATIVE COUNSEL'S DIGEST AB 1757, as amended, Waldron.  Local government finance.   North County Transit District.   Existing law provides for creation of the North County Transit District, with various powers and duties relative to the planning and operation of a transit system in north San Diego County. Existing law provides for the district to be governed by a board of directors, and requires compensation in the amount of $75 per day, not to exceed $300 per month, be paid to each board member or alternate for attending board meetings and authorizes similar, additional amounts for attending meetings of other public agencies.   This bill would instead provide for payments of $150 per meeting, not to exceed $750 per month, for board members, or alternates when acting on behalf of board members, for attending board meetings or meetings of other public agencies. The bill would thereby impose a state-mandated local program.   Existing law generally requires the North County Transit District to award contracts for construction that exceed $10,000 to the lowest responsible bidder after competitive bidding.   This bill would change this amount to $50,000.   The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.   This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.   Existing law, in the case of any county assuming the responsibilities of an independent local health special district created pursuant to a specified statute, requires an increase in the state assistance payments, as defined, that are made to that county.   This bill would make technical, nonsubstantive changes to this provision.  Vote: majority. Appropriation: no. Fiscal committee:  no   yes  . State-mandated local program:  no   yes  . THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 20351 of the   Public Contract Code   is amended to read:  20351. Contracts for the construction in excess of  ten  fifty  thousand dollars  ($10,000)   ($50,000)  shall be awarded to the lowest responsible bidder after competitive bidding, except in an emergency declared by the vote of two-thirds of the membership of the board.  SEC. 2.   Section 125107 of the   Public Utilities Code   is amended to read:  125107.  (a)    Each member of the board, including  the   an  alternate  members   member  appointed pursuant to Section  125051,   125051 when acting on behalf of the member,  shall be paid  seventy-five dollars ($75)   one h   undred fifty dollars ($150)  for each  day   meeting of the board or other meeting of a governmental entity  the member or alternate  attends meetings of the board,   attends,  but not to exceed  three hundred dollars ($300)   seven hundred fifty dollars ($750)  in any month, and  his   the  necessary and reasonable expenses in performing  his   the  duties as a board member.  (b) In addition to the compensation prescribed by subdivision (a), the board may, by resolution, authorize and designate members and alternates to be compensated for representing the board at specified meetings of other governmental entities and public agencies. Compensation may be seventy-five dollars ($75) for each day the designated member or alternate attends specified meetings, not to exceed three hundred dollars ($300) in any month.   SEC. 3.   Section 125220 of the   Public Utilities Code   is amended to read:  125220. The district may make contracts and enter into stipulations of any nature whatsoever, either in connection with eminent domain proceedings or otherwise, including, but not limited to, contracts and stipulations to indemnify and save harmless, to employ labor, to contract with a private patrol operator licensed pursuant to  Chapter 11   Article 4  (commencing with Section  7500)   7583)  of  Chapter 11.5 of  Division 3 of the Business and Professions Code, the county sheriff and municipal police departments within the areas described in Section 125052, and other transit development boards for security, police, and related services, and to do all acts necessary and convenient for the full exercise of the powers granted in this division.  SEC. 4.   If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.   SECTION 1.  Section 96.7 of the Revenue and Taxation Code is amended to read: 96.7. In the case of a county assuming the responsibilities of an independent local health special district created pursuant to former Chapter 6 (commencing with Section 880) of Part 2 of Division 1 of the Health and Safety Code, as enacted by Chapter 60 of the Statutes of 1939, for purposes of computations pursuant to this chapter, the amount of state assistance payments with respect to that county shall be increased by five hundred four thousand nine hundred fifty-seven dollars ($504,957).
