Existing law requires a school district to provide access to free, fresh drinking water during meal times in school food service areas by July 1, 2011, unless the governing board of a school district adopts a resolution stating that it is unable to comply with this requirement and demonstrating the reasons why it is unable to comply due to fiscal constraints or health and safety concerns. This bill would require the State Department of Education to establish, by regulation, a grant program for local educational agencies to install new water filling stations on school campuses or to replace existing water fountains on school campuses with new water filling stations. The bill would provide that its provisions shall not be implemented unless funding is provided for its purposes in the annual Budget Act or another statute. Existing law specifies the requirements for the 3-year preliminary designated subjects career technical education teaching credential. This bill would make a nonsubstantive change to that provision. Vote: majority. Appropriation: no. Fiscal committee: no yes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 38087 is added to the Education Code , to read: 38087. (a) The department shall establish, by regulation, a grant program for local educational agencies to install new water filler stations on school campuses. (b) Grant recipients may use grant funds only to install new water filling stations on school campuses or to replace existing water fountains on school campuses with new water filling stations. (c) For purposes of this section, "local educational agencies" include school districts, charter schools, and county offices of education. (d) This section shall not be implemented unless funding is provided for its purposes in the annual Budget Act or another statute. SECTION 1. Section 44260 of the Education Code is amended to read: 44260. The minimum requirements for the three-year preliminary designated subjects career technical education teaching credential shall be all of the following: (a) Three years or the equivalent of adequate, successful, and recent experience in, or experience and education in, the subject named on the credential. (b) Possession of a high school diploma or the passage of an equivalency examination as designated by the commission. (c) Satisfaction of the requirements for teacher. fitness, as specified in Sections 44339, 44340, and 44341. (d) Notwithstanding subdivision (a), the holder of a credential described in this section shall satisfy the minimum experience requirements established by the local educational agency for each course he or she is assigned to teach.
