Existing law creates the Public Employment Relations Board and prescribes its powers, which include deciding contested matters relating to the recognition, certification, or decertification of public employee organizations. Under existing law, a decertification petition must be accompanied by proof that at least 30% of the employees in the established unit either no longer wish to be represented by the incumbent exclusive representative or wish to be represented by another employee organization.   This bill would require the board to complete and publish the results of a decertification election within 90 days after the board has determined the sufficiency of the proof of support for the decertification petition.   Existing law requires the state to grant exclusive recognition to employee organizations designated or selected pursuant to rules established by the Public Employment Relations Board for employees of the state or appropriate unit thereof, as specified. Existing law also requires the board to establish procedures whereby recognition of employee organizations formally recognized as exclusive representatives pursuant to a vote of the employees may be revoked, as specified.   This bill would make a nonsubstantive change to this provision.  Vote: majority. Appropriation: no. Fiscal committee:  no   yes  . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:  SECTION 1.   Section 3541.32 is added to the   Government Code  , to read:   3541.32. The board shall complete and publish the results of a decertification election within 90 days after the board has determined the sufficiency of the proof of support for the decertification petition.   SECTION 1.   Section 3520.5 of the Government Code is amended to read: 3520.5. (a) The state shall grant exclusive recognition to employee organizations designated or selected pursuant to rules established by the board for employees of the state or an appropriate unit thereof, subject to the right of an employee to represent himself or herself. (b) The board shall establish reasonable procedures for petitions and for holding elections and determining appropriate units pursuant to subdivision (a). (c) The board shall also establish procedures whereby recognition of employee organizations formally recognized as exclusive representatives pursuant to a vote of the employees may be revoked by a majority vote of the employees only after a period of not less than 12 months following the date of such recognition.
