 BILL NUMBER: AB 2775INTRODUCED BILL TEXT INTRODUCED BY Assembly Member Gallagher FEBRUARY 19, 2016 An act to add Section 123472.5 to the Health and Safety Code, relating to public health. LEGISLATIVE COUNSEL'S DIGEST AB 2775, as introduced, Gallagher. Abortion services facilities: pregnancy center notice. Existing law requires a licensed covered facility, as defined, to disseminate to clients a notice, as specified, stating that California has public programs that provide immediate free or low-cost access to comprehensive family planning services, prenatal care, and abortion for eligible women. Existing law requires an unlicensed covered facility, as defined, to disseminate to clients a notice, as specified, stating that the facility is not licensed as a medical facility by the State of California and has no licensed medical provider. Existing law authorizes the Attorney General, city attorney, or county counsel to bring an action to impose a specified civil penalty against covered facilities that fail to comply with these requirements. This bill would require a facility that offers abortion services to disseminate a notice to clients, as specified, providing the contact information for a specified organization and stating that pregnancy centers can provide women with services that include counseling, pregnancy tests, sexually transmitted disease or sexually transmitted infection (STD/STI) testing, ultrasound services, support groups, parenting programs, and material assistance. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 123472.5 is added to the Health and Safety Code, to read: 123472.5. (a) A facility that offers abortion services shall disseminate to clients onsite the following notice in English and in the primary threshold languages for Medi-Cal beneficiaries as determined by the State Department of Health Care Services for the county in which the facility is located. (b) (1) The notice shall state: "If you intend to keep your baby, pregnancy centers can provide you with services that include counseling, pregnancy tests, sexually transmitted disease or sexually transmitted infection (STD/STI) testing, ultrasound services, support groups, parenting programs, and material assistance. (2) The onsite notice shall be a sign at least 8.5 inches by 11 inches and written in no less than 48-point type, and shall be posted conspicuously in the entrance of the facility and at least one additional area where clients wait to receive services.
