BILL NUMBER: SB 450INTRODUCED BILL TEXT INTRODUCED BY Senator Allen FEBRUARY 25, 2015 An act to amend Section 3022 of the Elections Code, relating to elections. LEGISLATIVE COUNSEL'S DIGEST SB 450, as introduced, Allen. Elections: sample ballots. Existing law, for each election, requires each appropriate elections official to cause to be printed sample ballots, as specified, and requires the sample ballots to be mailed to each registered voter not more than 40 nor less than 21 days before the election. Existing law requires the elections official to include with the sample ballot an application for a vote by mail ballot. This bill would require the application for a vote by mail ballot that is included with the sample ballot to include a space for the voter to apply for permanent vote by mail status. By requiring elections officials to provide a higher level of service, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions. Section 3022 of the Elections Code is amended to read: 3022. The elections official shall include with the sample ballot an application for a vote by mailballot.ba llot, and the application shall include a space for the voter to apply for permanent vote by mail status. SEC. 2. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
