BILL NUMBER: SB 905AMENDED BILL TEXT AMENDED IN SENATE APRIL 7, 2016 INTRODUCED BY Senator Berryhill Bates JANUARY 25, 2016 An act to amend add Section 19424 of 23428.29 to the Business and Professions Code, relating to horse racing. alcoholic beverage control. LEGISLATIVE COUNSEL'S DIGEST SB 905, as amended, Berryhill Bates . Horse racing: California Horse Racing Board. Alcoholic beverage control: club licenses. The Alcoholic Beverage Control Act, administrated by the Department of Alcoholic Beverage Control, defines and regulates the issuance of various types of licenses authorizing the sale of alcoholic beverages, including a club license. Existing law authorizes the holder of a club license to exercise the rights of a on-sale general licensee, but limits sale and service of alcoholic beverages to members of the club and their guests. Existing law defines different clubs in this context. This bill would define a club, for the purposes described above, to also include a nonprofit umbrella organization established to provide a central meeting location, resources, and services for veterans, including those on active duty, and that owns or leases, operates, and maintains a facility for these purposes. The bill would require the organization to serve at least 6 veteran organizations, as specified. The Horse Racing Law provides that no member of the California Horse Racing Board is disqualified from receiving a share of any purse awarded him as the result of any horse race as an owner of a horse or as a breeder of a California-bred horse. This bill would make nonsubstantive changes to that provision. Vote: majority. Appropriation: no. Fiscal committee: no yes . State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS: SECTION 1. Section 23428.29 is added to the Business and Professions Code , to read: 23428.29. For the purpose of this article, "club" also means a nonprofit umbrella organization established to provide a central meeting location, resources, and services specifically for veterans, including those on active duty, and that owns or leases, operates, and maintains a facility for these purposes. It shall be unlawful for any club licensed pursuant to this section to make any discrimination, distinction, or restriction against any person on account of the person's color, race, religion, ancestry, national origin, sex, or age. SECTION 1. Section 19424 of the Business and Professions Code is amended to read: 19424.
