CALIFORNIA LEGISLATURE 20192020 REGULAR SESSION Assembly Bill No. 1404Introduced by Assembly Member SantiagoFebruary 22, 2019 An act to amend Section 1339.585 of the Health and Safety Code, relating to health facilities. LEGISLATIVE COUNSEL'S DIGESTAB 1404, as introduced, Santiago. Payers Bill of Rights. Existing law provides for the licensure and regulation by the State Department of Public Health of health facilities, including hospitals. Existing law, the Payers Bill of Rights, requires a hospital, upon the request of a person without health coverage, to provide a written estimate of the amount the hospital will require the person to pay for the healthcare services, procedures, and supplies that are reasonably expected to be provided to the person by the hospital, as specified. Existing law also requires the hospital to provide information about its financial assistance and charity care policies, contact information for a hospital employee or office from which the person may obtain further information about these policies, and an application form for financial assistance or charity if requested. A knowing or negligent violation of those provisions is a misdemeanor. This bill would additionally require the hospital to provide information about how that person can apply for public health coverage programs. By imposing new requirements on a hospital, the bill would expand the definition of a crime, and would thereby impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.Digest Key Vote: MAJORITY Appropriation: NO Fiscal Committee: YES Local Program: YES Bill TextThe people of the State of California do enact as follows:SECTION 1.
