Amended IN Assembly March 12, 2020 CALIFORNIA LEGISLATURE 20192020 REGULAR SESSION Assembly Bill No. 2311Introduced by Assembly Member LowFebruary 14, 2020 An act to amend Section 10850 2600 of the Public Contract Code, relating to public contracts. LEGISLATIVE COUNSEL'S DIGESTAB 2311, as amended, Low. California State University Contract Law. Public contracts: skilled and trained workforce requirement: notice.Existing law establishes requirements that apply when a public entity is required by statute or regulation to obtain an enforceable commitment that a bidder, contractor, or other entity will use a skilled and trained workforce to complete a contract or project. Existing law also authorizes a public entity to require that a bidder, contractor, or other entity use a skilled and trained workforce to complete a contract or project. This bill would require a public entity, when the use of a skilled and trained workforce to complete a contract or project is required pursuant to existing law, to include in all bid documents and construction contracts a notice that the project is subject to the skilled and trained workforce requirement. The California State University Contract Law provides for the construction of public works by the Trustees of the California State University. Provisions of that law relating to performance authorize the trustees, if they deem that a contractor has failed to prosecute the work with the diligence and force specified by the contract, after specified written notice to the contractor, to provide labor or materials and deduct the cost from money due under the contract or, if the trustees consider that the failure is sufficient ground, to give written notice to the contractor and the contractors sureties that if the defaults are not remedied the contractors control over the work will be terminated. Existing law requires those notices to be served on the contractor or on the contractors agent having charge of the work, personally, or by registered mail addressed to the contractor or their agent, or, if neither can be located or their addresses are unknown, by posting in a conspicuous place upon the premises of the project. This bill would make nonsubstantive changes to that service provision.Digest Key Vote: MAJORITY Appropriation: NO Fiscal Committee: NOYES Local Program: NO Bill TextThe people of the State of California do enact as follows:SECTION 1.
