CALIFORNIA LEGISLATURE 20232024 REGULAR SESSION Assembly Bill No. 3024Introduced by Assembly Member WardFebruary 16, 2024 An act to amend Section 3495 of the Civil Code, relating to nuisances. LEGISLATIVE COUNSEL'S DIGESTAB 3024, as introduced, Ward. Public nuisance.Existing law defines a nuisance as anything which is injurious to health or is indecent or offensive to the senses, is an obstruction to the free use of property so as to interfere with the comfortable enjoyment of life or property, or unlawfully obstructs the free passage or use, in the customary manner, of any navigable lake, or river, bay, stream, canal, or basin, or any public park, square, street, or highway. Existing law defines a public nuisance as one that affects at the same time an entire community or neighborhood, or any considerable number of persons, although the extent of the annoyance or damage inflicted upon individuals may be unequal.Existing law authorizes a person to abate a public nuisance which is specially injurious to them by removing, or, if necessary, destroying the thing which constitutes the same, without committing a breach of the peace, or doing unnecessary injury. This bill would make a nonsubstantive change to that authorization.Digest Key Vote: MAJORITY Appropriation: NO Fiscal Committee: NO Local Program: NO Bill TextThe people of the State of California do enact as follows:SECTION 1.
