Seymour-Campbell Student Success Act of 2012: repeating credit courses.Existing law creates the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law authorizes community college districts throughout the state to provide instruction at the campuses they operate.Existing law, the Seymour-Campbell Student Success Act of 2012, provides that the purpose of the act is to increase California community college student access and success by providing effective core matriculation services of orientation, assessment and placement, counseling, and other education planning services, and academic interventions. The act requires, among other things, a community college district or community college to maximize the probability that students will enter and complete transfer-level coursework in English and mathematics within a one-year timeframe of their initial attempt in the discipline, as provided.This bill would require the governing board of each community college district to establish policies for the repetition of credit courses offered by the community colleges in the district. The bill would require these policies to include, but not be limited to, authorization for a student to repeat, up to, but not exceeding, 3 2 times, a credit course in arts, humanities, kinesiology, foreign languages, and English as a second language, for which the student previously received a satisfactory grade and which the student is retaking for enrichment or skill-building purposes, as provided.This bill would also require these policies to include authorization for a student to repeat, up to, but not exceeding, 5 times, a credit course for which the student previously received a grade indicating substandard work. If the repeated course is a transfer-level mathematics or English course, the bill would require that the policy require that the community college provide the student with concurrent supports after the first unsuccessful attempt of the transfer-level mathematics or English course, as provided. The bill would also require these policies to include requirements that a community college provide the student with a timely academic advising appointment and refer the student to support services, identify emergency student financial assistance, and maximize available resources to address the students basic needs, as provided, before authorizing the student to repeat a course after the 3rd attempt. The bill would require a community college district to submit a report on or before July 1, 2025, and annually thereafter, to the office of the Chancellor of the California Community Colleges on the total number of courses repeated and total number of students, aggregated by gender and ethnicity, who repeated courses. The bill would require the chancellor, on or before December 1, 2025, and annually thereafter, to prepare and submit to the Legislature and Director of Finance a summary report on course repetition, as provided. The bill would make the reporting requirements and the provisions related to policies authorizing a student to repeat, up to, but not exceeding, 5 times, a credit course for which the student previously received a grade indicating substandard work inoperative on July 1, 2029, and would repeal them as of January 1, 2030. This bill would require the policies to include a requirement that the community college inform a student whether the decision to repeat the course will impact the students federal and state financial aid qualifications, as provided, and to provide priority registration for credit courses to students who require the course for their intended major and to students who have not taken the course.This bill would require the Board of Governors to adopt regulations regarding the policies for the repetition of credit courses that are consistent with the requirements described above.By imposing additional duties on community college districts, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. It is the intent of the Legislature that nothing in Section 78213.3 of the Education Code, as added by Sections 2 and 3 of this act, shall be interpreted to subvert the implementation of Section 78213 of the Education Code and the requirement for community colleges to maximize the probability that a student will enter and complete transfer-level coursework in English and mathematics within a one-year timeframe of their initial attempt in the discipline.SEC. 2. Section 78213.3 is added to the Education Code, to read:78213.3. (a) The governing board of each community college district shall establish policies for the repetition of credit courses offered by the community colleges in the district. The policies shall be consistent with the regulations adopted pursuant to subdivision (b), describe the procedures for the repetition of credit courses, and include, but not be limited to, all of the following:(1) (A) Authorization for a student to repeat, up to, but not exceeding, five times, a credit course for which the student previously received a grade indicating substandard academic work. If the repeated course is a transfer-level mathematics or English course pursuant to Section 78213, the policies shall require a community college to provide the student with concurrent supports available to the student pursuant to subdivision (k) of Section 78213 after the first unsuccessful attempt of the transfer-level mathematics or English course.(B) Before authorizing a student to repeat a course described in subparagraph (A) after the third attempt, the policies shall require a community college to do all of the following: (i) Provide the student with a timely academic advising appointment and refer the student to support services offered by the community college for academic support.(ii) Identify emergency student financial assistance to help the student overcome unforeseen financial challenges that would directly impact the students ability to persist in the students course of study. (iii) Maximize available resources to address the students basic needs, through the provision of basic needs services and resources, as defined in Section 66023.5. (2) Authorization for a student to repeat, up to, but not exceeding, three two times, a credit course in arts, humanities, kinesiology, foreign languages, and English as a second language, for which the student previously received a satisfactory grade and which the student is retaking for enrichment or skill-building purposes.(3) A requirement that a community college inform a student who repeats a credit course whether the decision to repeat the credit course will impact the students financial aid qualifications under Title IV of the Higher Education Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.). The notification shall be provided to the student at least one time and through a communication method that may include, but is not limited to, an email, a written notification, an electronic notification when registering or reregistering for a course, or an in-person counseling appointment with a financial aid administrator after the student registers. The notification provided by the community college shall include all of the following information:(A) Clear guidance per the Federal Student Aid handbook in plain language on how the repetition of course work coursework would impact the students eligibility for Title IV financial aid, including how many times the student can repeat a course, whether the course counts towards toward the students six-year lifetime eligibility, and if a repeated course counts towards toward the students enrollment status.(B) Clear guidance per the Cal Grant handbook in plain language on how the repetition of coursework would impact the students four-year eligibility for state financial aid, including Cal Grants.(C) Information on how repeating a course can interact with the colleges satisfactory academic policies for both the quantitative, as determined by pace, and qualitative, as determined by grade, standards.(D) Information on discrepancies regarding what is a passing grade according to the Federal Student Aid handbook as compared to an institutions definition of a passing grade.(4) A requirement that a community college provide priority registration for credit courses to students who require the course for their intended major and to students who have not taken the course.(b) The Board of Governors of the California Community Colleges shall adopt regulations regarding the policies for the repetition of credit courses that are consistent with the requirements of subdivision (a).(c) (1) A community college district shall submit a report on or before July 1, 2025, and annually thereafter, to the office of the Chancellor of the California Community Colleges that includes all of the following information:(A) The total number of community college courses by course category and type repeated by students pursuant to paragraph (1) of subdivision (a).(B) The total number of students, aggregated by gender and ethnicity, who repeated community college courses pursuant to paragraph (1) of subdivision (a).(2) On or before December 1, 2025, and annually thereafter, the chancellor shall prepare a summary report of the data collected pursuant to paragraph (1). The report shall be submitted to the Legislature, in compliance with Section 9795 of the Government Code, and to the Director of Finance.(d) As used in this section, the following definitions apply:(1) Satisfactory grade means that for the course in question, the students academic record has been annotated with the symbol A, B, C, or P. (2) Substandard academic work means coursework for which the grading symbols D, F, FW, or NP have been recorded.(3) Support services means individual counseling and advising, technology-based strategies, corequisite courses, support-enhanced transfer-level mathematics or English courses, supervised tutoring, embedded tutoring, coteaching courses, tutoring, or any other academic supports offered by a community college to ensure that students can successfully complete a course of study. (e) This section shall become inoperative on July 1, 2029, and, as of January 1, 2030, is repealed.SEC. 3. Section 78213.3 is added to the Education Code, to read:78213.3. (a) The governing board of each community college district shall establish policies for the repetition of credit courses offered by the community colleges in the district. The policies shall be consistent with the regulations adopted pursuant to subdivision (b), describe the procedures for the repetition of credit courses, and include, but not be limited to, all of the following:(1) Authorization for a student to repeat, up to, but not exceeding, three two times, a credit course in arts, humanities, kinesiology, foreign languages, and English as a second language, for which the student previously received a satisfactory grade and which the student is retaking for enrichment or skill-building purposes. (2) A requirement that a community college inform a student who repeats a credit course pursuant to paragraph (1) whether the decision to repeat the credit course will impact the students financial aid qualifications under Title IV of the Higher Education Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.). (3) A requirement that a community college provide priority registration for credit courses to students who require the course for their intended major and to students who have not taken the course. (b) The Board of Governors of the California Community Colleges shall adopt regulations regarding the policies for the repetition of credit courses that are consistent with the requirements of subdivision (a).(c) As used in this section, satisfactory grade means that for the course in question, the students academic record has been annotated with the symbol A, B, C, or P. (d) This section shall become operative on July 1, 2029.SEC. 4. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.

(3) A requirement that a community college provide priority registration for credit courses to students who require the course for their intended major and to students who have not taken the course. (b) The Board of Governors of the California Community Colleges shall adopt regulations regarding the policies for the repetition of credit courses that are consistent with the requirements of subdivision (a).(c) As used in this section, satisfactory grade means that for the course in question, the students academic record has been annotated with the symbol A, B, C, or P. (d) This section shall become operative on July 1, 2029.SEC. 4. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.

(a) The governing board of each community college district shall establish policies for the repetition of credit courses offered by the community colleges in the district. The policies shall be consistent with the regulations adopted pursuant to subdivision (b), describe the procedures for the repetition of credit courses, and include, but not be limited to, all of the following:(1) (A) Authorization for a student to repeat, up to, but not exceeding, five times, a credit course for which the student previously received a grade indicating substandard academic work. If the repeated course is a transfer-level mathematics or English course pursuant to Section 78213, the policies shall require a community college to provide the student with concurrent supports available to the student pursuant to subdivision (k) of Section 78213 after the first unsuccessful attempt of the transfer-level mathematics or English course.(B) Before authorizing a student to repeat a course described in subparagraph (A) after the third attempt, the policies shall require a community college to do all of the following: (i) Provide the student with a timely academic advising appointment and refer the student to support services offered by the community college for academic support.(ii) Identify emergency student financial assistance to help the student overcome unforeseen financial challenges that would directly impact the students ability to persist in the students course of study. (iii) Maximize available resources to address the students basic needs, through the provision of basic needs services and resources, as defined in Section 66023.5. (2) Authorization for a student to repeat, up to, but not exceeding, three two times, a credit course in arts, humanities, kinesiology, foreign languages, and English as a second language, for which the student previously received a satisfactory grade and which the student is retaking for enrichment or skill-building purposes.(3) A requirement that a community college inform a student who repeats a credit course whether the decision to repeat the credit course will impact the students financial aid qualifications under Title IV of the Higher Education Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.). The notification shall be provided to the student at least one time and through a communication method that may include, but is not limited to, an email, a written notification, an electronic notification when registering or reregistering for a course, or an in-person counseling appointment with a financial aid administrator after the student registers. The notification provided by the community college shall include all of the following information:(A) Clear guidance per the Federal Student Aid handbook in plain language on how the repetition of course work coursework would impact the students eligibility for Title IV financial aid, including how many times the student can repeat a course, whether the course counts towards toward the students six-year lifetime eligibility, and if a repeated course counts towards toward the students enrollment status.(B) Clear guidance per the Cal Grant handbook in plain language on how the repetition of coursework would impact the students four-year eligibility for state financial aid, including Cal Grants.(C) Information on how repeating a course can interact with the colleges satisfactory academic policies for both the quantitative, as determined by pace, and qualitative, as determined by grade, standards.(D) Information on discrepancies regarding what is a passing grade according to the Federal Student Aid handbook as compared to an institutions definition of a passing grade.(4) A requirement that a community college provide priority registration for credit courses to students who require the course for their intended major and to students who have not taken the course.(b) The Board of Governors of the California Community Colleges shall adopt regulations regarding the policies for the repetition of credit courses that are consistent with the requirements of subdivision (a).(c) (1) A community college district shall submit a report on or before July 1, 2025, and annually thereafter, to the office of the Chancellor of the California Community Colleges that includes all of the following information:(A) The total number of community college courses by course category and type repeated by students pursuant to paragraph (1) of subdivision (a).(B) The total number of students, aggregated by gender and ethnicity, who repeated community college courses pursuant to paragraph (1) of subdivision (a).(2) On or before December 1, 2025, and annually thereafter, the chancellor shall prepare a summary report of the data collected pursuant to paragraph (1). The report shall be submitted to the Legislature, in compliance with Section 9795 of the Government Code, and to the Director of Finance.(d) As used in this section, the following definitions apply:(1) Satisfactory grade means that for the course in question, the students academic record has been annotated with the symbol A, B, C, or P. (2) Substandard academic work means coursework for which the grading symbols D, F, FW, or NP have been recorded.(3) Support services means individual counseling and advising, technology-based strategies, corequisite courses, support-enhanced transfer-level mathematics or English courses, supervised tutoring, embedded tutoring, coteaching courses, tutoring, or any other academic supports offered by a community college to ensure that students can successfully complete a course of study. (e) This section shall become inoperative on July 1, 2029, and, as of January 1, 2030, is repealed.

(2) A requirement that a community college inform a student who repeats a credit course pursuant to paragraph (1) whether the decision to repeat the credit course will impact the students financial aid qualifications under Title IV of the Higher Education Act of 1965, as amended (20 U.S.C. Sec. 1070 et seq.). (3) A requirement that a community college provide priority registration for credit courses to students who require the course for their intended major and to students who have not taken the course. (b) The Board of Governors of the California Community Colleges shall adopt regulations regarding the policies for the repetition of credit courses that are consistent with the requirements of subdivision (a).(c) As used in this section, satisfactory grade means that for the course in question, the students academic record has been annotated with the symbol A, B, C, or P. (d) This section shall become operative on July 1, 2029.

78213.3. (a) The governing board of each community college district shall establish policies for the repetition of credit courses offered by the community colleges in the district. The policies shall be consistent with the regulations adopted pursuant to subdivision (b), describe the procedures for the repetition of credit courses, and include, but not be limited to, all of the following:(1) Authorization for a student to repeat, up to, but not exceeding, three two times, a credit course in arts, humanities, kinesiology, foreign languages, and English as a second language, for which the student previously received a satisfactory grade and which the student is retaking for enrichment or skill-building purposes. (2) A requirement that a community college inform a student who repeats a credit course pursuant to paragraph (1) whether the decision to repeat the credit course will impact the students financial aid qualifications under Title IV of the Higher Education Act of 1965, as amended (20 U.S.C. SEC. 4. If the Commission on State Mandates determines that this act contains costs mandated by the state, reimbursement to local agencies and school districts for those costs shall be made pursuant to Part 7 (commencing with Section 17500) of Division 4 of Title 2 of the Government Code.
