It increases state workload on an ongoing basis. Appropriation Summary: No appropriation is required. Fiscal Note Status: The fiscal note reflects the introduced bill as recommended by the Legislative Audit Committee. Summary of Legislation The State Auditor completed a performance audit of the Colorado State Fair Authority (authority) in 2019. This bill includes recommendations from the audit that require legislation to implement. These recommendations include: clarifying that the Commissioner of Agriculture, in consultation with the authority board, will appoint and employ a manager for the authority; requiring the authority board to establish a process for approving industry displays; and allowing the authority to collaborate with a state agency or industry representative in developing an industry display. State Expenditures Under current law, the authority, which is located within the Department of Agriculture, is required to include displays of specific industry categories of the state of Colorado at the state fair. According to the audit, many industry categories have been represented minimally or not at all. This bill will increase workload for the authority board to develop a process for approving industry displays and for authority staff to collaborate with state agencies and industry representative to develop more industry displays. This workload increase can be accomplished with existing appropriations. Moving Page 2 January 14, 2022 HB 22-1022 the hiring responsibility of the authority manager from the board to the Commissioner of Agriculture can also be accomplished within existing appropriations. Effective Date The bill takes effect 90 days following adjournment of the General Assembly sine die, assuming no referendum petition is filed.
