The bill creates the Colorado jail standards commission (commission) in the department of public safety. The commission creates standards for the operation of Colorado's county jails (jails) and updates the standards as necessary. Dashes through the words indicate deletions from existing statute. ! 5 sheriffs or senior jail administrators; ! 2 county commissioners; ! 3 people with lived experience of being incarcerated or having a family member who is or was incarcerated in a jail; ! One mental health professional with experience working in a jail; ! One health professional with experience working in a jail; ! One person representing a lesbian, gay, bisexual, transgender, or queer advocacy organization; ! One person representing an organization advocating for the rights of people with disabilities; ! One person representing an organization advocating for the rights of communities of color; ! One person representing an organization advocating for the rights of persons with mental or physical disabilities; ! One non-law-enforcement person with experience working in a jail, appointed by the executive director of the department of public safety; ! The state public defender or the state public defender's designee; ! One district attorney, appointed by the Colorado district attorneys' council; and ! One person representing the department of public safety with expertise in jail operations. The commission shall develop standards for all aspects of jail operations as follows: ! Reception and release; ! Classification of inmates; ! Security; ! Housing; ! Sanitation and environmental conditions; ! Communication; ! Visitation; ! Health care, mental and behavioral health care, and dental care; ! Food service; ! Recreation and programming; ! Inmate disciplinary processes; ! Restrictive housing; ! Inmate grievances; ! Staffing; and ! Inmates' prerogatives. The commission shall establish standards regarding oversight of the standards; compliance with the standards, including a requirement for 1063 -2- a biennial compliance inspection of each jail; a complaint process and investigation process; and possible sanctions for noncompliance with or violations of the standards. The department of public safety shall promulgate rules adopting the standards and possible sanctions. The department of public safety shall provide oversight of the implementation of the standards. The commission shall evaluate the effectiveness of the standards after implementation and make any needed changes to the standards. The bill sunsets the commission on September 1, 2029. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add part 19 to article2 3 of title 2 as follows:3 PART 194 COLORADO JAIL STANDARDS COMMISSION5 2-3-1901. Legislative oversight committee for Colorado jail6 standards - creation - duties. (1) Creation. (a) THERE IS CREATED A7 LEGISLATIVE OVERSIGHT COMMITTEE CONCERNING COLORADO JAIL8 STANDARDS, REFERRED TO IN THIS PART 19 AS THE "COMMITTEE".9 (b) THE COMMITTEE CONSISTS OF SIX MEMBERS. THE PRESIDENT10 OF THE SENATE, THE MINORITY LEADER OF THE SENATE, THE SPEAKER OF11 THE HOUSE OF REPRESENTATIVES, AND THE MINORITY LEADER OF THE12 HOUSE OF REPRESENTATIVES SHALL APPOINT THE MEMBERS OF THE13 COMMITTEE AS FOLLOWS:14 (I) THE PRESIDENT OF THE SENATE SHALL APPOINT TWO SENATORS15 TO SERVE ON THE COMMITTEE AND DESIGNATE ONE OF THE SENATORS AS16 THE VICE-CHAIR OF THE COMMITTEE, AND THE MINORITY LEADER OF THE17 SENATE SHALL APPOINT ONE SENATOR TO SERVE ON THE COMMITTEE ;18 (II) THE SPEAKER OF THE HOUSE OF REPRESENTATIVES SHALL19 APPOINT TWO REPRESENTATIVES TO SERVE ON THE COMMITTEE AND20 1063-3- DESIGNATE ONE OF THE REPRESENTATIVES AS THE CHAIR OF THE1 COMMITTEE, AND THE MINORITY LEADER OF THE HOUSE OF2 REPRESENTATIVES SHALL APPOINT ONE REPRESENTATIVE TO SERVE ON THE3 COMMITTEE;4 (III) THE PRESIDENT OF THE SENATE, THE MINORITY LEADER OF5 THE SENATE, THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, AND THE6 MINORITY LEADER OF THE HOUSE OF REPRESENTATIVES SHALL MAKE THEIR7 APPOINTMENTS BY JULY 1, 2022. IN THE CASE OF A VACANCY, THE PERSON8 MAKING THE ORIGINAL APPOINTMENT OR REAPPOINTMENT SHALL FILL ANY9 VACANCY BY APPOINTMENT .10 (c) (I) MEMBERS OF THE COMMITTEE MAY RECEIVE PAYMENT OF11 PER DIEM AND REIMBURSEMENT FOR ACTUAL AND NECESSARY EXPENSES12 AUTHORIZED PURSUANT TO SECTION 2-2-307.13 (II) THE DIRECTOR OF RESEARCH OF THE LEGISLATIVE COUNCIL14 AND THE DIRECTOR OF THE OFFICE OF LEGISLATIVE LEGAL SERVICES SHALL15 SUPPLY STAFF ASSISTANCE TO THE COMMITTEE, BUT SHALL NOT SUPPLY16 STAFF ASSISTANCE TO ANY SUBCOMMITTEES CREATED BY THE COMMITTEE .17 (2) Duties. (a) THE COMMITTEE SHALL MEET NO MORE THAN FOUR18 TIMES EACH YEAR.19 (b) THE COMMITTEE IS RESPONSIBLE FOR THE OVERSIGHT OF THE20 COMMISSION. THE CHAIR OF THE COMMITTEE SHALL ESTABLISH21 ORGANIZATIONAL RULES AND PROCEDURAL RULES AS ARE NECESSARY FOR22 THE OPERATION OF THE COMMISSION .23 (c) THE COMMITTEE MAY INTRODUCE UP TO A TOTAL OF THREE24 BILLS, JOINT RESOLUTIONS, OR CONCURRENT RESOLUTIONS DURING THE25 2024 LEGISLATIVE SESSION. BILLS THAT THE COMMITTEE INTRODUCES ARE26 EXEMPT FROM THE FIVE-BILL LIMITATION SPECIFIED IN RULE 24 (b)(1)(A)27 1063 -4- OF THE JOINT RULES OF THE SENATE AND THE HOUSE OF REPRESENTATIVES .1 JOINT RESOLUTIONS AND CONCURRENT RESOLUTIONS THAT THE2 COMMITTEE INTRODUCES ARE EXEMPT FROM THE LIMITATIONS SET OUT IN3 RULE 26 (g) OF THE RULES OF THE HOUSE OF REPRESENTATIVES AND RULE4 30 (f) OF THE RULES OF THE SENATE. THE COMMITTEE IS EXEMPT FROM5 THE REQUIREMENT TO REPORT BILLS OR OTHER MEASURES TO THE6 LEGISLATIVE COUNCIL AS SPECIFIED IN RULE 24 (b)(1)(D) AND RULE 24A7 (d)(8) OF THE JOINT RULES OF THE SENATE AND THE HOUSE OF8 REPRESENTATIVES AND IN SECTION 2-3-303 (1)(f), COLORADO REVISED9 STATUTES. THE COMMITTEE IS SUBJECT TO RULE 24A OF THE JOINT RULES10 OF THE SENATE AND HOUSE OF REPRESENTATIVES, EXCEPT TO THE EXTENT11 THAT THE RULE MAY CONFLICT WITH THIS PART 19. BILLS RECOMMENDED12 BY THE COMMITTEE MUST BE INTRODUCED BY THE INTRODUCTION13 DEADLINE FOR HOUSE BILLS SPECIFIED IN RULE 23 (a)(1) OF THE JOINT14 RULES OF THE SENATE AND HOUSE OF REPRESENTATIVES. THE COMMISSION SHALL MEET MONTHLY. THE CHAIR OF9 THE COMMITTEE SHALL APPOINT A CHAIR AND VICE-CHAIR FROM AMONG10 THE COMMISSION MEMBERS. T HIS PART 19 IS REPEALED, EFFECTIVE5 JULY 1, 2024.6 7 SECTION 2. In Session Laws of Colorado 2021, amend section8 4 of chapter 322 as follows:9 Section 4. Effective date. This act takes effect upon passage;10 except that section 1 of this act takes effect on July 1, 2022 JULY 1, 2023,11 and section 2 of this act takes effect on January 1, 2022.12 SECTION 3. Appropriation. For the 2022-23 state fiscal year,13 $96,039 is appropriated to the legislative department. This appropriation14 is from the general fund. To implement this act, the department may use15 this appropriation as follows:16 (a) $90,379 for use by the legislative council, which amount is17 based on an assumption that the council will require an additional 0.918 FTE; and19 (b) $5,660 for use by the general assembly.20 SECTION 4. Safety clause. The general assembly hereby finds,21 determines, and declares that this act is necessary for the immediate22 preservation of the public peace, health, or safety.23 1063 -23-
