There is a state auxiliary services pilot program that arranges for the provision of auxiliary services for state departments and agencies that employ or serve individuals who are deaf, hard of hearing, and deafblind. Coordinate on a statewide basis the day-to-day scheduling for auxiliary services; ! Create and manage efficient and consistent processes through which an auxiliary services provider may submit required documentation and receive payment for auxiliary services provided; ! Create and manage a process for the intake and fulfillment of requests by state departments and agencies for auxiliary services; ! Resolve any issues that may arise with regard to auxiliary services; ! Communicate with auxiliary services users, auxiliary services providers, and appointing authorities; and ! Establish, monitor, and publish a list of CART providers and qualified interpreters. The bill requires the commission to convene an advisory council to make recommendations concerning the provision of auxiliary services. The bill requires the commission to include data on the functions of the program in its annual report to the governor and the general assembly. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 26-21-106, add (5.5)2 as follows:3 26-21-106. Powers, functions, and duties of commission -4 auxiliary services program - community access program - report -5 definitions - rules. (5.5) (a) T HE COMMISSION SHALL CONTINUE THE6 OPERATIONS OF THE STATE AUXILIARY SERVICES PROGRAM AS SET FORTH7 IN SUBSECTION (5) OF THIS SECTION. THE COMMISSION SHALL:8 (I) A RRANGE FOR THE PROVISION OF AUXILIARY SERVICES FOR9 STATE DEPARTMENTS AND AGENCIES , INCLUDING THE GOVERNOR'S OFFICE,10 THAT EMPLOY OR SERVE INDIVIDUALS WHO ARE DEAF , HARD OF HEARING,11 AND DEAFBLIND BY PERFORMING THE FOLLOWING FUNCTIONS :12 (A) C OORDINATING ON A STATEWIDE BASIS THE DAY -TO-DAY13 HB22-1143-2- SCHEDULING FOR AUXILIARY SERVICES PROVIDED TO STATE DEPARTMENTS1 AND AGENCIES;2 (B) C REATING AND MANAGING EFFICIENT AND CONSISTENT3 PROCESSES THROUGH WHICH AN AUXILIARY SERVICES PROVIDER MAY4 SUBMIT REQUIRED DOCUMENTATION AND RECEIVE PAYMENT FOR5 AUXILIARY SERVICES PROVIDED;6 (C) C REATING AND MANAGING A PROCESS FOR THE INTAKE AND7 FULFILLMENT OF REQUESTS BY STATE DEPARTMENTS AND AGENCIES FOR8 AUXILIARY SERVICES, INCLUDING THE IDENTIFICATION, COORDINATION,9 AND APPOINTMENT OF AUXILIARY SERVICES PROVIDERS , TO MEET THE10 NEEDS OF ALL PARTIES INVOLVED IN THE PROCEEDING , EVENT, OR11 CIRCUMSTANCE FOR WHICH A REQUEST IS MADE ;12 (D) R ESOLVING ANY ISSUES THAT MAY ARISE WITH REGARD TO13 AUXILIARY SERVICES IN THE STATE DEPARTMENT OR AGENCY FOR WHICH14 AUXILIARY SERVICES ARE PROVIDED PURSUANT TO THIS SUBSECTION (5.5);15 (E) C OMMUNICATING WITH AUXILIARY SERVICES USERS ,16 AUXILIARY SERVICES PROVIDERS , AND APPOINTING AUTHORITIES , AS17 DEFINED IN SECTION 13-90-202 (1), IN THE STATE DEPARTMENT OR18 AGENCY FOR WHICH AUXILIARY SERVICES ARE PROVIDED PURSUANT TO19 THIS SUBSECTION (5.5);20 (F) E STABLISHING, MONITORING, AND PUBLISHING A LIST OF CART21 PROVIDERS AND QUALIFIED INTERPRETERS , AS DEFINED IN SUBSECTIONS22 (4)(g)(II)(A) AND (4)(g)(II)(B) OF THIS SECTION, ON THE COMMISSION'S23 PUBLIC WEBSITE; AND24 (G) G ATHERING DATA ON THE FUNCTIONS DESCRIBED IN25 SUBSECTIONS (5.5)(a)(I)(A) TO (5.5)(a)(I)(F) OF THIS SECTION;26 (II) C REATE AN ADVISORY COUNCIL AND APPOINT MEMBERS TO27 HB22-1143 -3- MAKE RECOMMENDATIONS TO THE COMMISSION CONCERNING THE1 PROVISION OF AUXILIARY SERVICES TO STATE DEPARTMENTS AND2 AGENCIES.3 (b) T HE EXECUTIVE DIRECTOR SHALL PROMULGATE RULES FOR THE4 IMPLEMENTATION OF THIS SUBSECTION (5.5) IN CONSULTATION WITH, OR5 AS PROPOSED BY, THE COMMISSION AND THE DEAF, HARD OF HEARING, AND6 DEAFBLIND COMMUNITY .7 (c) T HE COMMISSION SHALL INCLUDE DATA GATHERED PURSUANT8 TO SUBSECTION (5.5)(a)(I)(G) OF THIS SECTION IN ITS ANNUAL REPORT9 REQUIRED BY SUBSECTION (1)(e) OF THIS SECTION.10 SECTION 2. Act subject to petition - effective date. This act11 takes effect at 12:01 a.m. on the day following the expiration of the12 ninety-day period after final adjournment of the general assembly; except13 that, if a referendum petition is filed pursuant to section 1 (3) of article V14 of the state constitution against this act or an item, section, or part of this15 act within such period, then the act, item, section, or part will not take16 effect unless approved by the people at the general election to be held in17 November 2022 and, in such case, will take effect on the date of the18 official declaration of the vote thereon by the governor.19 HB22-1143 -4-
