It may increase local government revenue and expenditures beginning in FY 2022-23. Appropriation Summary: No appropriation is required. Fiscal Note Status: The fiscal note reflects the introduced bill. Summary of Legislation The bill requires the owner or operator of any wind-powered energy generation facility subject to land-use permitting requirements to install an aircraft detection lighting system at their own cost by September 1, 2024. Local governments that issue land-use permits for such facilities may revoke or refuse to renew a permit for an applicant who is out of compliance. The bill authorizes a board of county commissioners to impose by ordinance a civil penalty for violations. Any contiguous counties and any municipalities in those counties may enter into an intergovernmental agreement for a shared ordinance. Local Government Beginning in FY 2022-23, expenditures may increase in local governments that elect to adopt ordinances, enter into intergovernmental agreements, or to inspect wind-powered generation facilities, as allowed by the bill. To the extent that violations occur, revenue will increase to local governments from civil penalties.
