The bill ensures that carbon management projects, except for agricultural, forestry, and enhanced oil recovery projects, are eligible for money under the industrial and manufacturing operations clean air grant program. The bill also requires the Colorado energy office (office) and the office of economic development to contract with an organization for the development of a carbon management roadmap for the state. After receiving a draft of the roadmap, the office will solicit feedback on the roadmap and the contracted organization will use that feedback to update the roadmap. The office will present the updated roadmap to the relevant committees in the general assembly and then later update the general assembly on the implementation of the roadmap. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, 24-38.5-116, amend2 (3)(b)(III); and add (3)(b)(VIII) as follows:3 24-38.5-116. Industrial and manufacturing operations clean4 air grant program - creation - eligibility - fund created - gifts, grants,5 or donations - transfer - legislative declaration - definitions -6 reporting - repeal. (3) Grant program. (b) In administering the grant7 program, the office shall:8 (III) Develop criteria for awarding money under the grant9 program, which criteria must include CONSIDERING STATEWIDE CARBON10 MANAGEMENT PRIORITIES INCLUDING COMMUNITY AND HEALTH11 PROTECTIONS AND REQUIRING PROJECT DATA REPORTING AS DETERMINED12 IN THE CARBON MANAGEMENT ROADMAP CREATED IN SECTION13 24-38.5-119 AND giving priority for voluntary projects located in:14 (VIII) (A) E NSURE THAT ALL TYPES OF CARBON MANAGEMENT15 PROJECTS, WITH THE EXCEPTION OF AGRICULTURAL , FORESTRY, AND16 ENHANCED OIL RECOVERY PROJECTS , ARE ELIGIBLE FOR MONEY UNDER17 THE GRANT PROGRAM.18 1210-2- (B) AS USED IN THIS SUBSECTION (3)(b)(VIII), "CARBON1 MANAGEMENT" HAS THE SAME MEANING AS SET FORTH IN SECTION2 24-38.5-119 (1)(a), AND "ENHANCED OIL RECOVERY " HAS THE SAME3 MEANING AS SET FORTH IN SECTION 24-38.5-119 (1)(b).4 SECTION 2. In Colorado Revised Statutes, add 24-38.5-119 as5 follows:6 24-38.5-119. Carbon management roadmap - creation -7 requirements - report - definitions - repeal. (1) A S USED IN THIS8 SECTION, UNLESS THE CONTEXT OTHERWISE REQUIRES :9 (a) "C ARBON MANAGEMENT " MEANS ANY OF THE FOLLOWING:10 (I) C ARBON DIOXIDE REMOVAL , WHICH MEANS THE REMOVAL OF11 CARBON DIOXIDE FROM THE ATMOSPHERE ;12 (II) C ARBON CAPTURE, WHICH MEANS A PROCESS THAT CAPTURES13 CARBON DIOXIDE EMISSIONS BEFORE THEY ARE RELEASED INTO THE14 ATMOSPHERE AND DIVERTS THOSE EMISSIONS FOR USE OR STORAGE ;15 (III) C ARBON SEQUESTRATION OR STORAGE, WHICH MEANS16 VERIFIABLY STORING CARBON DIOXIDE IN NON -ATMOSPHERIC LOCATIONS17 IN SUCH A MANNER THAT THE CARBON DIOXIDE WILL NOT ENTER THE18 ATMOSPHERE FOR AT LEAST ONE HUNDRED YEARS ; AND19 (IV) C ARBON UTILIZATION, WHICH MEANS A PROCESS BY WHICH20 CAPTURED OR REMOVED CARBON IS USED WITHOUT BEING RELEASED INTO21 THE ATMOSPHERE.22(b) "ENHANCED OIL RECOVERY " MEANS ALL EXISTING AND23 POTENTIAL TECHNOLOGY TO RECOVER OIL BEYOND TRADITIONAL PRIMARY24 METHODS, INCLUDING THE USE OF CARBON DIOXIDE OR OTHER FLUIDS TO25 INCREASE THE ULTIMATE RECOVERY OF HYDROCARBON .26 (c) "M ONITORING AND REPORTING" MEANS THE MEASUREMENT27 1210 -3- AND REPORTING OF CARBON MANAGEMENT USING AN OBJECTIVE ,1 PEER-REVIEWED, AND SCIENTIFICALLY SUPPORTED METHODOLOGY THAT2 TAKES INTO ACCOUNT BOTH REGIONALLY APPROPRIATE SAMPLING AND3 DATA COLLECTION METHODS TO QUANTIFY EMISSIONS AND REMOVALS4 ASSOCIATED WITH THE CARBON MANAGEMENT PROCESS AND THE5 DURABILITY OF THE CARBON MANAGEMENT PROCESS . "MONITORING AND6 REPORTING" DOES NOT MEAN USING MODEL -BASED OR STATISTICAL7 METHODS OF MEASUREMENT AND REPORTING .8 (d) "O FFICE" MEANS THE COLORADO ENERGY OFFICE.9 (e) "Q UALIFIED ORGANIZATION" MEANS AN ORGANIZATION OR10 ORGANIZATIONS THAT DO NOT HAVE A CLEAR CONFLICT OF INTEREST,11 HAVE NOT ACTIVELY LOBBIED FOR OR AGAINST CARBON MANAGEMENT IN12 THE LAST FIVE YEARS, AND THAT HAVE THE FOLLOWING TYPES OF13 EXPERTISE:14 (I) T ECHNICAL AND RESEARCH EXPERTISE IN CARBON15 MANAGEMENT TECHNOLOGIES , INCLUDING BUT NOT LIMITED TO:16 (A) A FFORESTATION, REFORESTATION, AND IMPROVED FOREST17 MANAGEMENT;18 (B) I NORGANIC AND ORGANIC SOIL CARBON SEQUESTRATION ;19 (C) B IOCHAR;20 (D) B IO ENERGY WITH CARBON CAPTURE AND STORAGE ; 21 (E) D IRECT AIR CAPTURE AND STORAGE;22 (F) B IOMASS WITH CARBON REMOVAL AND STORAGE ;23 (G) E NHANCED WEATHERING ;24 (H) C ARBON MINERALIZATION;25 (I) D URABLE GEOLOGICAL CARBON SEQUESTRATION ;26 (J) V ERIFIABLE INDUSTRIAL CARBON CAPTURE PROCESSES ; AND27 1210 -4- (K) DURABLE PROTEIN-BASED CARBON SEQUESTRATION ; 1 (L) AGRICULTURE PRODUCTION CARBON CAPTURE AND REMOVAL;2 (II) E CONOMIC AND MARKET DEVELOPMENT EXPERTISE IN3 ASSESSING THE MARKET RISKS AND OPPORTUNITIES FOR CARBON4 MANAGEMENT PRODUCTS AND APPLICATIONS; AND5 (III) EXPERTISE IN CARBON AND GREENHOUSE GAS EMISSIONS6 ACCOUNTING AND VERIFICATION .7 (f) "R OADMAP" MEANS THE CARBON MANAGEMENT ROADMAP FOR8 THE STATE OF COLORADO.9 (2) (a) O N OR BEFORE JANUARY 1, 2024, THE OFFICE SHALL, IN10 COLLABORATION WITH THE COLORADO OFFICE OF ECONOMIC11 DEVELOPMENT AND THE DEPARTMENT OF PUBLIC HEALTH AND12 ENVIRONMENT, CONTRACT WITH A QUALIFIED ORGANIZATION FOR THE13 DEVELOPMENT OF A CARBON MANAGEMENT ROADMAP FOR THE STATE OF14 C OLORADO.15 (b) O N OR BEFORE SEPTEMBER 1, 2024, THE QUALIFIED16 ORGANIZATION SHALL PRESENT THE ROADMAP TO THE OFFICE, THE17 C OLORADO OFFICE OF ECONOMIC DEVELOPMENT, AND THE DEPARTMENT18 OF PUBLIC HEALTH AND ENVIRONMENT. THE OFFICE SHALL HOLD AT LEAST19 ONE PUBLIC HEARING TO SOLICIT FEEDBACK ON THE ROADMAP AND INVITE20 COMMENT ON THE ROADMAP'S ENVIRONMENTAL HEALTH IMPACTS,21 INCLUDING LIFE CYCLE EMISSIONS ANALYSES OF CARBON MANAGEMENT22 PROJECTS IDENTIFIED BY THE ROADMAP AND EFFECTS ON23 DISPROPORTIONATELY IMPACTED COMMUNITIES .24 (c) O N OR BEFORE DECEMBER 1, 2024, THE OFFICE SHALL PRESENT25 THE FEEDBACK IT HAS COLLECTED ON THE ROADMAP TO THE QUALIFIED26 ORGANIZATION AND MAKE THE FEEDBACK AND THE ROADMAP AVAILABLE27 1210 -5- TO THE GENERAL ASSEMBLY .1 (d) O N OR BEFORE FEBRUARY 28, 2025, THE QUALIFIED2 ORGANIZATION SHALL PRESENT AN UPDATED VERSION OF THE ROADMAP3 THAT CONSIDERS THE PUBLIC COMMENTS PROVIDED BY THE OFFICE . 4 (e) D URING THE 2025 LEGISLATIVE SESSION, THE OFFICE SHALL5 PRESENT THE ROADMAP TO THE HOUSE OF REPRESENTATIVES ENERGY AND6 ENVIRONMENT COMMITTEE AND THE SENATE TRANSPORTATION AND7 ENERGY COMMITTEE OR THEIR SUCCESSOR COMMITTEES .8 (3) THE ROADMAP MUST IDENTIFY:9 (a) T HE CARBON MANAGEMENT , CLIMATE, AND ECONOMIC10 OPPORTUNITIES AVAILABLE IN COLORADO THAT BEST DRAW ON11 C OLORADO'S NATURAL RESOURCES, INDUSTRY, TALENT, LABOR FORCE,12 AND ECONOMIC DEVELOPMENT CAPABILITIES . IN IDENTIFYING ECONOMIC13 OPPORTUNITIES, THE ROADMAP MUST SPECIFICALLY INCLUDE THE14 FOLLOWING ECONOMIC SECTORS :15 (I) C ONSTRUCTION;16 (II) A GRICULTURE;17 (III) F OREST MANAGEMENT ;18 (IV) M INE RECLAMATION;19 (V) I NDUSTRIAL MANUFACTURING ;20 (VI) C EMENT AND CONCRETE;21 (VII) F OOD AND BEVERAGE; AND3 (III) E NSURING THAT PROJECT GOALS CAN BE VALIDATED BY4 RIGOROUS MONITORING AND REPORTING METHODS IN LINE WITH EMERGING5 INTERNATIONAL BEST PRACTICES AND STANDARDS ; AND6(g) RECOMMENDATIONS , INCLUDING LEGISLATIVE7 RECOMMENDATIONS FOR THE GENERAL ASSEMBLY AND ADMINISTRATIVE8 RECOMMENDATIONS FOR STATE AGENCIES , ON ISSUES RELATED TO CARBON9 MANAGEMENT.10 (4) I N CREATING THE ROADMAP, IN ADDITION TO SATISFYING THE11 REQUIREMENTS OF SUBSECTION (3) OF THIS SECTION, THE QUALIFIED12 ORGANIZATION SHALL GATHER :13 (a) W HERE PRACTICABLE, PROJECT DATA ON THE AMOUNT OF14 CARBON, CARBON DIOXIDE, AND CO-POLLUTANTS CAPTURED , EMITTED,15 REMOVED, STORED, OR UTILIZED FOR THE PURPOSE OF:16 (I) H ELPING TO ASSESS THE MARKET POTENTIAL FOR17 PERFORMANCE-BASED FINANCIAL INCENTIVES IN THE FUTURE ; 18 (II) E LEVATING THE CARBON MANAGEMENT POTENTIAL OF19 VARIOUS PROPOSALS AND TECHNOLOGIES ; AND20(III) PROVIDING INPUT ON CARBON MANAGEMENT FOR THE21 GREENHOUSE GAS POLLUTION REDUCTION ROADMAP ; AND22 (b) O PERATIONAL DATA INCLUDING :23 (I) Q UANTITIES AND TYPES OF MATERIALS NEEDED FOR CARBON24 MANAGEMENT FACILITY CONSTRUCTION AND OPERATION ;25 (II) T HE NUMBER AND TYPES OF JOBS THAT WILL BE CREATED26 RELATED TO CARBON MANAGEMENT AS WELL AS THE TIMELINE OF JOB27 1210 -10- CREATION;1 (III) T HE OPERATIONAL REQUIREMENTS FOR CARBON2 MANAGEMENT FACILITIES INCLUDING ENERGY INFRASTRUCTURE ,3 PROJECTED ENERGY NEEDS, CONSTRUCTION COSTS, AND STAFFING; THE OFFICE SHALL WORK WITH OTHER STATE AGENCIES9 AS APPROPRIATE IN ORDER TO ENSURE THAT THE ROADMAP FUNCTIONS IN10 CONCERT WITH OTHER STATE TARGETS, TEAMS, AND DOCUMENTS,11 INCLUDING THE GREENHOUSE GAS POLLUTION REDUCTION ROADMAP,12 GREENHOUSE GAS ACCOUNTING MEASURES, AND THE COLORADO CARBON13 CAPTURE AND GEOLOGICAL SEQUESTRATION TASK FORCE REPORT .14 (6) (a) I N SOLICITING FEEDBACK ON THE ROADMAP PURSUANT TO15 SUBSECTION (2)(b) OF THIS SECTION, THE OFFICE SHALL CONDUCT 16 MEETINGS WITH INTERESTED PE RSONS THROUGHOUT THE STATE ,17 INCLUDING:18 (I) L ABOR ORGANIZATIONS;19 (II) E NVIRONMENTAL ADVOCACY GROUPS ;20 (III) I NDUSTRIES OR PROFESSIONS RELATED TO CARBON21 MANAGEMENT;22 (IV) S TATEWIDE ASSOCIATIONS OF MECHANICAL , ELECTRICAL,23 AND PLUMBING CONTRACTORS ;24 (V) T RIBAL AND LOCAL GOVERNMENTS ; AND 25 (VI) C OMMUNITY LEADERS, INCLUDING COMMUNITY LEADERS26 FROM DISPROPORTIONATELY IMPACTED COMMUNITIES .27 1210 -11- (b) THE OFFICE SHALL ALSO SOLICIT FEEDBACK FROM : 1 (I) T HE COLORADO OFFICE OF ECONOMIC DEVELOPMENT ; 2 (II) T HE DEPARTMENT OF TRANSPORTATION ;3 (III) T HE DEPARTMENT OF NATURAL RESOURCES ;4 (IV) T HE DEPARTMENT OF AGRICULTURE ;5 (V) T HE STATE ARCHITECT;6 (VI) T HE GOVERNOR'S OFFICE;7 (VII) T HE ENVIRONMENTAL JUSTICE OMBUDSPERSON IN THE8 DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT APPOINTED9 PURSUANT TO SECTION 25-1-134 (1) OR THE OMBUDSPERSON'S DESIGNEE;10 11 (VIII) T HE DIRECTOR OF THE JUST TRANSITION OFFICE CREATED IN12 SECTION 8-83-503 OR THE DIRECTOR'S DESIGNEE; AND13 (IX) THE AIR POLLUTION AND CONTROL DIVISION .14 (7) D URING THE 2026 AND 2027 LEGISLATIVE SESSIONS, THE15 OFFICE SHALL PRESENT TO THE HOUSE OF REPRESENTATIVES ENERGY AND16 ENVIRONMENT COMMITTEE AND THE SENATE TRANSPORTATION AND17 ENERGY COMMITTEE OR THEIR SUCCESSOR COMMITTEES :18 (a) T HE PROGRESS MADE IN IMPLEMENTING THE GOALS IDENTIFIED19 IN THE ROADMAP; AND20 (b) A NY RECOMMENDATIONS , INCLUDING LEGISLATIVE21 RECOMMENDATIONS FOR THE GENERAL ASSEMBLY AND ADMINISTRATIVE22 RECOMMENDATIONS FOR STATE AGENCIES , NECESSARY TO BETTER23 IMPLEMENT THE GOALS IDENTIFIED IN THE ROADMAP .24 (8) THIS SECTION AND THE ROADMAP CREATED PURSUANT TO THIS25 SECTION DO NOT PREVENT PUBLIC AND PRIVATE ACTORS FROM ADVANCING26 THEIR OWN PROJECTS UNDER EXISTING RULES AND REGULATIONS .27 1210 -12- SECTION 3. Appropriation. For the 2023-24 state fiscal year,1 $135,533 is appropriated to the office of the governor for use by the2 Colorado energy office. This appropriation is from the general fund and3 is based on an assumption that the office will require an additional 0.44 FTE. To implement this act, the office may use this appropriation for5 program administration.6 SECTION 4. Act subject to petition - effective date. This act7 takes effect at 12:01 a.m. on the day following the expiration of the8 ninety-day period after final adjournment of the general assembly; except9 that, if a referendum petition is filed pursuant to section 1 (3) of article V10 of the state constitution against this act or an item, section, or part of this11 act within such period, then the act, item, section, or part will not take12 effect unless approved by the people at the general election to be held in13 November 2024 and, in such case, will take effect on the date of the14 official declaration of the vote thereon by the governor.15 1210 -13-
