Colorado Youth Advisory Council Committee. The bill establishes the office of disordered eating prevention (office) in the department of public health and environment (department). Collaborate with the office of suicide prevention, the behavioral health administration, and organizations within the health-care industry to close gaps in care and provide support to individuals with disordered eating who transition out of inpatient care, facilitate public outreach, and increase awareness regarding disordered eating prevention and care with a focus on impacted communities, such as youth, people of color, and lesbian, gay, bisexual, and transgender individuals; ! Create outreach resources directing youth on how to seek care for disordered eating and how to report concerns for other youth, with a focus on impacted communities, such as lesbian, gay, bisexual, and transgender youth and youth of color; ! Partner with the department of education to inform teachers, administrators, school staff, students, and parents on disordered eating preventions and treatment for youth; ! Collaborate with advocacy groups, including faith-based organizations, to support a shift in public perception regarding health-care systems and disordered eating treatment and prevention; ! Coordinate the disordered eating prevention research grant program; and ! Prepare written information for primary care offices and providers throughout the state. The information must be culturally specific concerning how to recognize and respond to a patient with disordered eating and include separate written information for providers and information that may be shared with an adult patient or a youth patient and the caregivers of the youth patient. The bill creates the disordered eating prevention commission (commission) in the department. The commission will have 17 members with professional or personal connections to disordered eating prevention. The purpose of the commission is to: ! Provide public and private leadership on disordered eating prevention in Colorado; ! Set statewide, data-driven, evidence-based, and clinically informed priorities for disordered eating prevention in Colorado; ! Serve as the advisor to the office of disordered eating prevention; SB23-014 -2- ! Establish and lead subgroups to set strategy and implementation plans for the office; ! Provide a forum for government agencies, community members, and lawmakers to examine the current status of disordered eating prevention policies; ! Provide a voice for youth and focus on youth issues; ! Provide a forum for diverse perspectives to support and inform diverse communities; and ! Provide a forum for perspectives from rural communities to support and inform rural communities. The bill creates the disordered eating prevention research grant program (grant program) in the department. The purpose of the grant program is to provide financial assistance to eligible applicants to conduct research on risk factors for disordered eating, the impact disordered eating has on Colorado, or public health interventions that examine and address the root causes of disordered eating. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. In Colorado Revised Statutes, add part 20 to article2 20.5 of title 25 as follows:3 PART 204 OFFICE OF DISORDERED5 EATING PREVENTION6 25-20.5-2001. Legislative declaration. (1) T HE GENERAL7 ASSEMBLY FINDS AND DECLARES THAT :8 (a) E ATING DISORDERS ARE INCREASINGLY RECOGNIZED AS A9 LEADING CAUSE OF MORBIDITY AND MORTALITY ;10 (b) I N 2015, COLORADO HAD THE FIFTH-HIGHEST RATE OF EATING11 DISORDERS IN THE COUNTRY AMONG YOUTH ;12 (c) E ATING DISORDERS ARE A MENTAL ILLNESS THAT HAVE THE13 HIGHEST MORTALITY RATE OF ANY PSYCHIATRIC ILLNESS ;14 (d) P EOPLE OF COLOR; LESBIAN, GAY, BISEXUAL, OR TRANSGENDER15 INDIVIDUALS; AND YOUTH ARE MORE LIKELY TO SUFFER FROM16 SB23-014-3- DISORDERED EATING BUT LESS LIKELY TO RECEIVE EATING DISORDER1 TREATMENT, CREATING A DISPROPORTIONATE GAP IN EATING DISORDER2 PREVENTION AND CARE; AND3 (e) T HERE IS LIMITED STATE-SPECIFIC RESEARCH ON DISORDERED4 EATING AND ITS IMPACTS ON THE STATE OF COLORADO.5 (2) T HE GENERAL ASSEMBLY FINDS , THEREFORE, THAT TO6 UNDERSTAND DISORDERED EATING AND ITS IMPACTS ON COLORADANS,7 THE STATE MUST FOCUS ON DEVELOPING RESEARCH AND RESOURCES TO8 EDUCATE COLORADANS ON THE SEVERITY OF DISORDERED EATING AND9 SUPPORT COLORADANS WHO DEVELOP DISORDERED EATING . IT IS ALSO10 IMPORTANT TO RECOGNIZE THAT DISORDERED EATING HARMS AND11 INCREASES THE MORTALITY RATE OF PEOPLE OF COLOR ; LESBIAN, GAY,12 BISEXUAL, OR TRANSGENDER INDIVIDUALS; AND YOUTH.13 25-20.5-2002. Definitions. A S USED IN THIS PART 20, UNLESS THE14 CONTEXT OTHERWISE REQUIRES :15 (1) "C OMMISSION" MEANS THE DISORDERED EATING PREVENTION16 COMMISSION CREATED IN SECTION 25-20.5-2004.17 (2) "D EPARTMENT" MEANS THE DEPARTMENT OF PUBLIC HEALTH18 AND ENVIRONMENT CREATED PURSUANT TO SECTION 25-1-102.19 (3) "D ISORDERED EATING" MEANS A RANGE OF IRREGULAR EATING20 DISORDERS THAT MAY WARRANT A DIAGNOSIS .21 (4) "D ISORDERED EATING PREVENTION RESEARCH GRANT22 PROGRAM" OR "GRANT PROGRAM " MEANS THE DISORDERED EATING23 PREVENTION RESEARCH GRANT PROGRAM CREATED IN SECTION24 25-20.5-2005.25 (5) "O FFICE OF DISORDERED EATING PREVENTION " MEANS THE26 OFFICE OF DISORDERED EATING PREVENTION CREATED IN SECTION27 SB23-014 -4- 25-20.5-2003.1 (6) "Y OUTH" MEANS AN INDIVIDUAL WHO IS LESS THAN2 TWENTY-FIVE YEARS OF AGE.3 25-20.5-2003. Office of disordered eating prevention - creation4 - reports. (1) O N OR BEFORE JULY 1, 2024, THE OFFICE OF DISORDERED5 EATING PREVENTION IS CREATED IN THE DEPARTMENT UNDER THE6 AUSPICES OF THE PREVENTION SERVICES DIVISION , ESTABLISHED IN7 SECTION 25-20.5-103. THE OFFICE OF DISORDERED EATING PREVENTION8 SERVES AS THE COORDINATOR FOR EATING DISORDER PROGRAMS9 THROUGHOUT THE STATE , INCLUDING THE DISORDERED EATING10 PREVENTION RESEARCH GRANT PROGRAM .11 (2) T HE DEPARTMENT AND THE OFFICE OF DISORDERED EATING12 PREVENTION SHALL:13 (a) C REATE AND MAINTAIN A RESOURCE BANK FOR RESEARCH ,14 INTERVENTION METHODS , TREATMENT RESOURCES , INFORMATION ON15 CRISIS SERVICES, AWARENESS PROGRAMS, AND EDUCATIONAL RESOURCES16 REGARDING DISORDERED EATING PREVENTION AND CARE IN COLORADO.17 T HE RESOURCE BANK MUST BE YOUTH -FRIENDLY, CULTURALLY SENSITIVE,18 AND, WHEN POSSIBLE, AVAILABLE IN BOTH ENGLISH AND SPANISH. IN19 CREATING THE RESOURCE BANK , THE DEPARTMENT AND OFFICE OF20 DISORDERED EATING PREVENTION SHALL SOLICIT INPUT FROM PERSONS ,21 INCLUDING YOUTH AND ADULTS , WITHIN AND OUTSIDE OF THE MENTAL22 HEALTH PROFESSION, INCLUDING BOTH COMMUNITY AND SCHOOL MENTAL23 HEALTH PROFESSIONALS.24 (b) C OLLABORATE WITH THE OFFICE OF SUICIDE PREVENTION ,25 CREATED IN SECTION 25-1.5-101 (1)(w), THE BEHAVIORAL HEALTH26 ADMINISTRATION CREATED IN SECTION 27-50-102, AND ORGANIZATIONS27 SB23-014 -5- WITHIN THE HEALTH-CARE INDUSTRY TO CLOSE GAPS IN CARE , PROVIDE1 SUPPORT TO INDIVIDUALS WITH DISORDERED EATING WHO TRANSITION OUT2 OF INPATIENT CARE, FACILITATE PUBLIC OUTREACH , AND INCREASE3 AWARENESS REGARDING DISORDERED EATING PREVENTIONS AND CARE4 WITH A FOCUS ON IMPACTED COMMUNITIES , SUCH AS YOUTH, PEOPLE OF5 COLOR, AND LESBIAN, GAY, BISEXUAL, AND TRANSGENDER INDIVIDUALS ;6 (c) C REATE OUTREACH RESOURCES DIRECTING YOUTH ON HOW TO7 SEEK CARE FOR DISORDERED EATING AND HOW TO REPORT CONCERN FOR8 OTHER YOUTH. THE OUTREACH RESOURCES MUST HAVE A FOCUS ON9 IMPACTED COMMUNITIES , SUCH AS LESBIAN, GAY, BISEXUAL, AND10 TRANSGENDER YOUTH AND YOUTH OF COLOR .11 (d) P ARTNER WITH THE DEPARTMENT OF EDUCATION TO INFORM12 TEACHERS, ADMINISTRATORS, SCHOOL STAFF, STUDENTS, AND PARENTS ON13 DISORDERED EATING PREVENTION AND TREATMENT OF YOUTH ;14 (e) C OLLABORATE WITH ADVOCACY GROUPS , INCLUDING15 FAITH-BASED ORGANIZATIONS, TO SUPPORT A SHIFT IN PUBLIC PERCEPTION16 REGARDING HEALTH-CARE SYSTEMS AND DISORDERED EATING TREATMENT17 AND PREVENTION;18 (f) C OORDINATE THE DISORDERED EATING PREVENTION RESEARCH19 GRANT PROGRAM; AND20 (g) P REPARE WRITTEN INFORMATION FOR PRIMARY CARE OFFICES21 AND PROVIDERS THROUGHOUT THE STATE . THE INFORMATION MUST BE22 CULTURALLY SPECIFIC CONCERNING HOW TO RECOGNIZE AND RESPOND TO23 A PATIENT WITH DISORDERED EATING AND INCLUDE SEPARATE WRITTEN24 INFORMATION FOR PROVIDERS AND INFORMATION THAT MAY BE SHARED25 WITH AN ADULT PATIENT OR A YOUTH PATIENT AND THE CAREGIVERS OF26 THE YOUTH PATIENT.27 SB23-014 -6- (3) THE DEPARTMENT MAY SEEK , ACCEPT, AND EXPEND GIFTS,1 GRANTS, OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE2 PURPOSES OF THIS SECTION.3 (4) N OTWITHSTANDING SECTION 24-1-136 (11)(a)(I), ON OR4 BEFORE NOVEMBER 1, 2024, AND EVERY NOVEMBER 1 THEREAFTER, THE5 OFFICE OF DISORDERED EATING PREVENTION SHALL SUBMIT TO THE6 HEALTH AND HUMAN SERVICES COMMITTEE OF THE SENATE AND THE7 PUBLIC AND BEHAVIORAL HEALTH AND HUMAN SERVICES COMMITTEE OF8 THE HOUSE OF REPRESENTATIVES , OR ANY SUCCESSOR COMMITTEES , A9 REPORT THAT SUMMARIZES THE RECOMMENDATIONS FROM THE10 COMMISSION PURSUANT TO SECTION 25-20.5-2004 (4) AND THE11 INFORMATION THE DEPARTMENT RECEIVES REGARDING THE DISORDERED12 EATING PREVENTION RESEARCH GRANT PROGRAM PURSUANT TO SECTION13 25-20.5-2005 (3)(b). T HE OFFICE OF DISORDERED EATING PREVENTION14 SHALL INCLUDE IN THE REPORT ANY FINDINGS AND RECOMMENDATIONS IT15 HAS TO IMPROVE DISORDERED EATING PREVENTION IN THE STATE .16 25-20.5-2004. Disordered eating prevention commission -17 creation - responsibilities - repeal. (1) T HERE IS CREATED IN THE18 DEPARTMENT THE DISORDERED EATING PREVENTION COMMISSION . Disordered eating prevention research grant16 program - creation - process - reporting requirements - definitions -17 repeal. (1) A S USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE18 REQUIRES:19 (a) "E LIGIBLE APPLICANT" MEANS AN INDIVIDUAL, NONPROFIT20 ORGANIZATION, OR FOR-PROFIT ORGANIZATION THAT CONDUCTS21 RESEARCH ON DISORDERED EATING AND PREVENTION IN YOUTH AND22 ADULTS OR SERVES YOUTH AND ADULTS WHO HAVE DISORDERED EATING23 TRAITS.24 (b) "G RANT RECIPIENT" MEANS AN ELIGIBLE APPLICANT THAT THE25 DEPARTMENT SELECTS TO RECEIVE MONEY THROUGH THE GRANT26 PROGRAM.27 SB23-014 -10- (2) (a) THERE IS CREATED IN THE DEPARTMENT THE DISORDERED1 EATING PREVENTION RESEARCH GRANT PROGRAM . THE PURPOSE OF THE2 GRANT PROGRAM IS TO PROVIDE FINANCIAL ASSISTANCE TO ELIGIBLE3 APPLICANTS TO CONDUCT RESEARCH ON RISK FACTORS FOR DISORDERED4 EATING IN YOUTH AND ADULTS, THE IMPACT DISORDERED EATING HAS ON5 C OLORADO, OR PUBLIC HEALTH INTERVENTIONS FOR DISORDERED EATING6 THAT EXAMINE AND ADDRESS THE ROOT CAUSES FOR DISORDERED EATING .7 (b) T HE DEPARTMENT SHALL ADMINISTER THE GRANT PROGRAM IN8 CONSULTATION WITH THE OFFICE OF DISORDERED EATING PREVENTION .9 (c) O N OR BEFORE OCTOBER 1, 2024, THE OFFICE OF DISORDERED10 EATING PREVENTION SHALL MAKE RECOMMENDATIONS TO THE11 DEPARTMENT REGARDING THE ADMINISTRATION OF THE GRANT PROGRAM ,12 AND THE DEPARTMENT SHALL ADOPT GUIDELINES FOR THE GRANT13 PROGRAM. THE GUIDELINES MUST INCLUDE:14 (I) A PPLICATION PROCEDURES BY WHICH ELIGIBLE APPLICANTS15 MAY APPLY FOR A GRANT PURSUANT TO THIS SECTION ;16 (II) C RITERIA TO USE IN SELECTING ELIGIBLE APPLICANTS TO17 RECEIVE GRANT MONEY AND DETERMINING THE AMOUNT OF GRANT18 MONEY TO BE AWARDED TO EACH GRANT RECIPIENT ; AND19 (III) P ROCEDURES FOR THE ADMINISTRATION OF THE GRANT20 PROGRAM, INCLUDING THE DATES THE DEPARTMENT AND THE OFFICE OF21 DISORDERED EATING PREVENTION ANNOUNCE THE GRANT PROGRAM ,22 BEGIN ACCEPTING APPLICATIONS, ALLOW ELIGIBLE APPLICANTS TO SUBMIT23 APPLICATIONS, AND BEGIN DISTRIBUTING GRANT MONEY TO THE24 GRANTEES.25 (d) T HE DEPARTMENT SHALL GRANT AT LEAST ONE -QUARTER OF26 THE AMOUNT APPROPRIATED TO THE GRANT PROGRAM TO GRANT27 SB23-014 -11- RECIPIENTS WHOSE RESEARCH FOCUSES ON DISORDERED EATING IN YOUTH .1 (3) (a) E ACH GRANT RECIPIENT SHALL SUBMIT A WRITTEN REPORT2 TO THE DEPARTMENT NO LATER THAN SIX MONTHS AFTER THE EXPIRATION3 OF THE TERM OF ITS GRANT. THE REPORT MUST INCLUDE A SUMMARY OF4 THE RESEARCH MADE POSSIBLE BY THE GRANT MONEY .5 (b) T HE DEPARTMENT SHALL INCLUDE IN THE REPORT REQUIRED6 PURSUANT TO SECTION 25-20.5-2003 (4) THE FOLLOWING INFORMATION7 REGARDING THE ADMINISTRATION OF THE GRANT PROGRAM DURING THE8 PRECEDING YEAR:9 (I) T HE NUMBER OF GRANT RECIPIENTS THAT RECEIVED MONEY10 FROM THE GRANT PROGRAM ;11 (II) T HE AMOUNT OF EACH GRANT AWARD TO EACH GRANT12 RECIPIENT;13 (III) A SUMMARY OF GRANT RECIPIENTS ' WRITTEN REPORTS14 DESCRIBED IN SUBSECTION (3)(a) OF THIS SECTION.15 (4) T HE DEPARTMENT MAY SEEK , ACCEPT, AND EXPEND GIFTS,16 GRANTS, OR DONATIONS FROM PRIVATE OR PUBLIC SOURCES FOR THE17 PURPOSES OF THIS SECTION.18 (5) T HIS SECTION IS REPEALED, EFFECTIVE JULY 1, 2027.19 SECTION 2. (1) The department has, in addition to all other25 powers and duties imposed upon it by law, the powers and duties26 provided in this section as follows:27 SB23-014 -12- (dd) TO OPERATE THE OFFICE OF DISORDERED EATING PREVENTION1 CREATED IN SECTION 25-20.5-2003 IN THE DEPARTMENT UNDER THE2 AUSPICES OF THE PREVENTION SERVICES DIVISION , ESTABLISHED IN3 SECTION 25-20.5-103.4 SECTION 3. In Colorado Revised Statutes, 2-3-1203, add (24)5 as follows:6 2-3-1203. Sunset review of advisory committees - legislative7 declaration - definition - repeal. (24) Reserved. THE FOLLOWING8 STATUTORY AUTHORIZATIONS FOR THE DESIGNATED ADVISORY9 COMMITTEES WILL REPEAL ON SEPTEMBER 1, 2033:10 (a) T HE DISORDERED EATING PREVENTION COMMISSION CREATED11 IN SECTION 25-20.5-2004.12 (b) T HIS SUBSECTION (24) IS REPEALED, EFFECTIVE SEPTEMBER 1,13 2035.14 SECTION 4. Act subject to petition - effective date. This act15 takes effect at 12:01 a.m. on the day following the expiration of the16 ninety-day period after final adjournment of the general assembly; except17 that, if a referendum petition is filed pursuant to section 1 (3) of article V18 of the state constitution against this act or an item, section, or part of this19 act within such period, then the act, item, section, or part will not take20 effect unless approved by the people at the general election to be held in21 November 2024 and, in such case, will take effect on the date of the22 official declaration of the vote thereon by the governor.23 SB23-014 -13-
