The apprenticeship program is run collaboratively with the United States department of labor apprenticeship office (DOL office) and utilizes apprentice mentor teachers and apprenticeship program sponsors. The bill allows CDE to issue a teacher apprenticeship authorization (authorization) to a person (apprentice) who is employed by a school district, board of cooperative services, charter school, or institute charter school (school) who is actively registered in an apprenticeship program, and who is actively enrolled in an affiliated bachelor's degree program from an accredited institution. The authorization is valid for 4 years while the apprentice completes the bachelor's degree requirement of the program. CDE may renew the authorization for 2 years. An authorization is invalid if the apprentice withdraws from any part of the apprenticeship program or fails to make satisfactory progress. Upon application from an entity with expertise in apprenticeship or teacher preparation, CDE shall authorize the entity to serve as a teacher apprenticeship program sponsor (sponsor). Applications to serve as a sponsor must include a proposed work process schedule and related instruction required by the DOL office. CDE shall review each application and approve or disapprove the sponsor. If approved, the sponsor may apply to CDE for approval of an apprenticeship program. An apprenticeship program must meet the following criteria: ! Be registered with the DOL office; ! Incorporate a bachelor's degree program from an accredited institution in a related field of study relative to the licensure type; and ! Incorporate on-the-job training in meaningful and time-saving ways. Every 5 years after apprenticeship program approval, CDE shall consult with the DOL office concerning the federally required audit of the apprenticeship program to ensure the apprenticeship program continues to meet requirements. Be it enacted by the General Assembly of the State of Colorado:1 SECTION 1. Legislative declaration. (1) The general assembly2 finds and declares that:3 (a) The state of Colorado has a significant teacher shortage;4 (b) According to the Colorado department of education, in the5 2021-22 school year, the state needed to hire seven thousand teachers and6 other support services professionals;7 087-2- (c) The existing teacher preparation system only produced three1 thousand two hundred and one educators. Further, persons who complete2 existing teacher preparation programs do not represent the diverse3 populations they serve, as seventy-two percent of persons who complete4 such programs are female and seventy-four percent are White.5 (d) The current paths to teacher licensure limit the number and6 types of individuals who can access them. The existing traditional and7 alternative teacher preparation programs have established important8 standards of rigor that can be applied to new frameworks to positively9 impact the teacher shortage.10 (e) New paths to licensure are more suitable for first-generation11 college students, individuals who require full-time employment,12 individuals already working in schools, individuals outside of the13 commuting distance of existing teacher programs, and others who lack14 access to traditional teacher preparation programs;15 (f) The current alternative path to teacher licensure offers an16 opportunity only for those individuals who already hold a bachelor's17 degree;18 (g) Another option to make teacher licensure accessible to19 Coloradans who do not yet hold a bachelor's degree is necessary to20 expand the teacher candidate pool and meet the needs of Colorado's21 schools and students;22 (h) A teacher degree apprenticeship program builds on elements23 established by current alternative routes, including a bachelor's degree24 requirement, department of education-approved training programs, and25 structured on-the-job training. A teacher degree apprenticeship program26 gets teachers teaching more quickly, keeps rural residents training and27 087 -3- working in their communities, and ultimately sets apprentices up for1 success by putting first-year teachers in the classroom with years of2 practical experience from an apprenticeship. It positions apprentices to3 begin the first year of teaching with more than four thousand hours of4 on-the-job experience and creates flexibility without sacrificing quality5 standards.6 (i) A paid United States department of labor-approved registered7 apprenticeship incorporated into a licensure pathway would create a more8 equitable path to a career in education. Apprenticeship in a teacher9 licensure program further ensures quality by not only adhering to the10 United States department of labor-approved registered apprenticeship11 competencies, but also aligns with the Colorado department of education12 quality standards.13 (j) Coloradans would benefit from an earn-and-learn model that14 incorporates apprenticeship and allows for flexibility in degree and15 licensure.16 (2) Therefore, the general assembly declares that it is necessary to17 create a new teacher licensure program in Colorado that authorizes18 registered apprenticeship as a path to licensure.19 SECTION 2. In Colorado Revised Statutes, 22-60.5-102, add20 (3.5), (6.5), (6.7), (8.5), (9.1), (22), and (23) as follows:21 22-60.5-102. Definitions. As used in this article 60.5, unless the22 context otherwise requires:23 (3.5) "A FFILIATED BACHELOR'S DEGREE PROGRAM" MEANS THE24 BACHELOR'S DEGREE THAT IS IDENTIFIED IN THE INSTRUCTION PLAN25 SUBMITTED BY THE TEACHER APPRENTICESHIP PROGRAM SPONSOR .26 (6.5) "A PPRENTICE MENTOR TEACHER" MEANS A PROFESSIONALLY27 087 -4- LICENSED TEACHER IN GOOD STANDING , DESIGNATED BY THE1 APPRENTICESHIP PROGRAM SPONSOR , WHO PROVIDES EXEMPLARY2 MODELING AND COUNSELING TO A TEACHER APPRENTICE , WHO IS TRAINED3 IN THE APPRENTICESHIP MODEL, AND WHO TAKES RESPONSIBILITY FOR THE4 TRAINING, MENTORING, AND PROGRESS OF THE TEACHER APPRENTICE .5 6 (8.5) "B OARD OF COOPERATIVE SERVICES" OR "BOCES" HAS THE7 SAME MEANING AS SET FORTH IN SECTION 22-5-103.8 (9.1) "C ERTIFICATE OF APPRENTICESHIP COMPLETION " MEANS A9 CERTIFICATE THAT HAS BEEN ISSUED BY THE UNITED STATES DEPARTMENT10 OF LABOR OR THE APPRENTICESHIP AGENCY THAT CERTIFIES A TEACHER11 APPRENTICE HAS SATISFACTORILY GAINED THE SKILLS , ABILITIES, AND12 COMPETENCIES, AND COMPLETED THE REQUIREMENTS OF AN13 APPRENTICESHIP.14 (22) "T EACHER APPRENTICE" MEANS A STUDENT WHO IS15 REGISTERED AND ENROLLED IN AN APPROVED TEACHER DEGREE16 APPRENTICESHIP PROGRAM, IS ENROLLED IN AN AFFILIATED BACHELOR'S17 DEGREE PROGRAM FROM AN ACCREDITED INSTITUTION , AND HAS18 OBTAINED A COLORADO TEACHER APPRENTICESHIP AUTHORIZATION19 PURSUANT TO SECTION 22-60.5-111. A "TEACHER APPRENTICE" CAN ALSO20 MEAN A STUDENT ENROLLED IN AN APPROVED TEACHER DEGREE21 APPRENTICESHIP PROGRAM THAT IS REGISTERED BEFORE THE EFFECTIVE22 DATE OF THIS SUBSECTION (22).23 (23) "T EACHER APPRENTICESHIP PROGRAM SPONSOR " MEANS AN 24 ENTITY RESPONSIBLE FOR THE REGISTRATION , ADMINISTRATION, AND25 OPERATION OF A TEACHER DEGREE APPRENTICESHIP PROGRAM THAT HAS26 BEEN APPROVED BY THE UNITED STATES DEPARTMENT OF LABOR OR THE27 087 -5- STATE APPRENTICESHIP AGENCY AND HAS BEEN AUTHORIZED BY THE1 STATE DEPARTMENT OF EDUCATION . A TEACHER APPRENTICESHIP2 PROGRAM SPONSOR CAN ALSO MEAN AN ENTITY SERVING AS A SPONSOR3 FOR AN APPRENTICESHIP PROGRAM THAT IS REGISTERED BEFORE THE4 EFFECTIVE DATE OF THIS SECTION.5 (24) "TEACHER DEGREE APPRENTICESHIP PROGRAM " MEANS A6 TEACHER EDUCATION PROGRAM CONTAINING ALL OF THE ELEMENTS OF A7 COMPETENCY-BASED, REGISTERED APPRENTICESHIP PROGRAM REQUIRED8 BY THE UNITED STATES DEPARTMENT OF LABOR AS EVIDENCED BY9 APPROVAL BY THE UNITED STATES DEPARTMENT OF LABOR OFFICE OF10 APPRENTICESHIP OR A STATE APPRENTICESHIP AGENCY AND APPROVED BY11 THE STATE DEPARTMENT OF EDUCATION AND SPONSORED BY A TEACHER12 APPRENTICESHIP PROGRAM SPONSOR OR A TEACHER APPRENTICESHIP13 PROGRAM APPROVED PRIOR TO THE EFFECTIVE DATE OF THIS SUBSECTION14 (23).15 SECTION 3. In Colorado Revised Statutes, 22-60.5-111, add16 (16) as follows:17 22-60.5-111. Authorization - types - applicants' qualifications18 - rules. (16) Teacher apprenticeship authorization. (a) (I) T HE19 DEPARTMENT MAY ISSUE A TEACHER APPRENTICESHIP AUTHORIZATION TO20 A TEACHER APPRENTICE THAT ALLOWS THE TEACHER APPRENTICE TO BE21 EMPLOYED BY A LOCAL EDUCATION PROVIDER AS A TEACHER APPRENTICE22 IN ROLES OF INCREASING RESPONSIBILITY , INCLUDING WORKING AS A23 SUBSTITUTE TEACHER AND A TEACHER OF RECORD . TO RECEIVE A24 TEACHER APPRENTICESHIP AUTHORIZATION , A PERSON SHALL:25 (A) B E EMPLOYED BY A SCHOOL DISTRICT , BOCES, CHARTER26 SCHOOL, OR INSTITUTE CHARTER SCHOOL AS A TEACHER APPRENTICE ;27 087 -6- (B) BE ACTIVELY REGISTERED IN A TEACHER APPRENTICESHIP1 PROGRAM; AND2 (C) B E ACTIVELY ENROLLED IN AN AFFILIATED BACHELOR 'S3 DEGREE PROGRAM FROM AN ACCREDITED INSTITUTION .4 (II) T HE DEPARTMENT SHALL ISSUE A TEACHER APPRENTICESHIP5 AUTHORIZATION TO A PERSON WHO MEETS THE CRITERIA PURSUANT TO6 SUBSECTION (16)(a)(I) OF THIS SECTION NO LATER THAN FORTY-FIVE DAYS7 AFTER RECEIPT OF THE INITIAL APPLICATION.8 (III) T HE TEACHER APPRENTICESHIP AUTHORIZATION IS VALID FOR9 A PERIOD OF FOUR YEARS WHILE THE TEACHER APPRENTICE COMPLETES10 THE AFFILIATED BACHELOR 'S DEGREE AND ON -THE-JOB TRAINING11 REQUIREMENTS. AN AUTHORIZATION IS RENEWABLE FOR UP TO TWO12 SUCCESSIVE TERMS, IN INCREMENTS OF TWO YEARS, AS NECESSARY FOR13 THE TEACHER APPRENTICE TO FULFILL THE APPRENTICESHIP14 REQUIREMENTS.15 (IV) T HE TEACHER APPRENTICESHIP AUTHORIZATION IS16 AUTOMATICALLY REVOKED IF THE TEACHER APPRENTICE WITHDRAWS17 FROM THE TEACHER APPRENTICESHIP PROGRAM OR WITHDRAWS FROM THE18 AFFILIATED BACHELOR 'S DEGREE PROGRAM . THE TEACHER 19 APPRENTICESHIP PROGRAM SPONSOR MAY REVOKE THE AUTHORIZATION20 IF THE TEACHER APPRENTICE DOES NOT MAKE SATISFACTORY PROGRESS IN21 THE TEACHER APPRENTICESHIP PROGRAM , AS DETERMINED BY THE22 EMPLOYER. THE TEACHER APPRENTICESHIP PROGRAM SPONSOR IS23 RESPONSIBLE FOR NOTIFYING THE DEPARTMENT WHEN A TEACHER24 APPRENTICE WITHDRAWS FROM THE TEACHER DEGREE APPRENTICESHIP25 PROGRAM.26 (b) T HE STATE BOARD OF EDUCATION SHALL PROMULGATE RULES 27 087 -7- DEFINING THE NECESSARY QUALIFICATIONS AND COMPETENCIES FOR EACH1 LEVEL OF AUTHORIZATION, INCLUDING:2 (I) A UTHORIZATION FOR THE TEACHER APPRENTICE TO WORK AS3 A SUBSTITUTE TEACHER;4 (II) A UTHORIZATION TO STUDENT TEACH ; AND 5 (III) A UTHORIZATION TO WORK AS A TEACHER OF RECORD . THIS 6 AUTHORIZATION REQUIRES A PASSING SCORE ON THE APPROPRIATE STATE7 BOARD OF EDUCATION -APPROVED CONTENT EXAM OR PORTFOLIO8 EQUIVALENTS, IF RELEVANT TO THE ENDORSEMENT AREA , AND MUST NOT9 REQUIRE COMPLETION OF A BACHELOR 'S DEGREE. THE DEPARTMENT'S10 RULES MUST NOT CREATE UNREASONABLE BARRIERS THAT PREVENT11 ACCESS TO THE PROGRAM.12 SECTION 4. In Colorado Revised Statutes, add 22-60.5-111.513 as follows:14 22-60.5-111.5. Teacher degree apprenticeship program -15 guidelines - teacher apprenticeship program sponsors - application16 for authorization with the department - criteria for authorization -17 program audit. (1) T HE DEPARTMENT SHALL CREATE AND ESTABLISH18 GUIDELINES FOR A TEACHER DEGREE APPRENTICESHIP PROGRAM ON OR19 BEFORE JANUARY 1, 2024. THE DEPARTMENT'S GUIDELINES MUST NOT20 CREATE UNREASONABLE BARRIERS THAT PREVENT ACCESS TO THE21 TEACHER APPRENTICESHIP PROGRAM . THE GUIDELINES MUST INCLUDE:22 (a) T HE MINIMUM PASSING SCORE FOR ANY EXAMINATION , WHICH23 MUST NOT EXCEED WHAT IS REQUIRED FOR ANY TEACHER LICENSURE24 CANDIDATE;25 (b) A PPRENTICE COMPETENCIES ALIGNED TO THE COLORADO 26 TEACHER QUALITY STANDARDS AND LICENSURE AREA CONTENT27 087 -8- STANDARDS, WHICH ARE INDEPENDENTLY AND EXCLUSIVELY EVALUATED1 BY THE APPRENTICE MENTOR TEACHER , PROGRAM ADMINISTRATOR , OR2 PROGRAM EVALUATOR ;3 (c) A PROVISION THAT APPRENTICE MENTOR TEACHERS ARE4 SELECTED AT THE FULL DISCRETION OF THE EMPLOYER ; AND5 (d) A REQUIREMENT THAT A TEACHER APPRENTICE WORKS AS A6 TEACHER OF RECORD FOR A MINIMUM OF ONE YEAR .7 (2) (a) T HE STATE BOARD OF EDUCATION SHALL AUTHORIZE8 QUALIFIED AGENCIES WITH EXPERTISE IN APPRENTICESHIP OR IN TEACHER9 PREPARATION TO SERVE AS TEACHER APPRENTICESHIP PROGRAM SPONSORS10 IN PARTNERSHIP WITH EMPLOYER PARTNERS , INCLUDING ANY SCHOOL11 DISTRICTS, BOCES, CHARTER SCHOOLS , NONPUBLIC SCHOOLS , OR12 INSTITUTES. THE DEPARTMENT SHALL DETERMINE THE NUMBER OF NEW13 AGENCIES ELIGIBLE TO RECEIVE AUTHORIZATION .14 (b) A N ENTITY THAT WISHES TO SERVE AS A TEACHER 15 APPRENTICESHIP PROGRAM SPONSOR SHALL NOTIFY THE STATE16 DEPARTMENT OF EDUCATION AND SUBMIT AN APPLICATION THAT , AT A17 MINIMUM, DOCUMENTS THE ENTITY'S EXPERTISE WITH APPRENTICESHIP OR18 WITH TEACHER PREPARATION .19 (c) W ITHIN THIRTY DAYS AFTER AN ENTITY SUBMITS A COMPLETE20 APPLICATION TO THE STATE DEPARTMENT OF EDUCATION , THE STATE21 BOARD OF EDUCATION SHALL NOTIFY THE ENTITY THAT THE STATE BOARD22 OF EDUCATION HAS EITHER APPROVED OR DISAPPROVED THE SPONSORSHIP23 APPLICATION.24 (3) (a) I N ADDITION TO SUBMITTING AN APPLICATION TO BE25 APPROVED AS A TEACHER APPRENTICESHIP PROGRAM SPONSOR , THE26 ENTITY SHALL SUBMIT AN APPLICATION FOR THE SPONSOR 'S TEACHER27 087 -9- DEGREE APPRENTICESHIP PROGRAM TO THE STATE BOARD OF EDUCATION1 FOR APPROVAL. THE APPLICATION FOR THE TEACHER DEGREE2 APPRENTICESHIP PROGRAM MUST INCLUDE A WORK PROCESS SCHEDULE3 AND RELATED INSTRUCTION PLAN AS SET FORTH BY THE UNITED STATES4 DEPARTMENT OF LABOR OR A STATE APPRENTICESHIP AGENCY .5 (b) T HE STATE DEPARTMENT OF EDUCATION SHALL REVIEW6 APPLICATIONS FOR THE TEACHER DEGREE APPRENTICESHIP PROGRAM AND7 SHALL MAKE RECOMMENDATIONS TO THE STATE BOARD OF EDUCATION8 FOR APPROVAL OR DENIAL OF THE APPLICATIONS .9 (c) W ITHIN NINETY DAYS AFTER A TEACHER APPRENTICESHIP10 PROGRAM SPONSOR SUBMITS A COMPLETE APPLICATION TO THE STATE11 DEPARTMENT OF EDUCATION , THE STATE BOARD OF EDUCATION SHALL12 NOTIFY THE TEACHER APPRENTICESHIP PROGRAM SPONSOR THAT THE13 STATE BOARD OF EDUCATION HAS EITHER APPROVED OR DENIED THE14 APPLICATION FOR THE TEACHER DEGREE APPRENTICESHIP PROGRAM . IF15 THE APPLICATION IS DENIED, THE STATE BOARD OF EDUCATION SHALL CITE16 THE REASONS FOR THE DENIAL.17 (4) A N APPROVED TEACHER DEGREE APPRENTICESHIP PROGRAM18 MUST MEET THE FOLLOWING CRITERIA :19 (a) B E REGISTERED WITH THE UNITED STATES DEPARTMENT OF20 LABOR'S OFFICE OF APPRENTICESHIP OR STATE APPRENTICESHIP AGENCY ; 21 (b) I NCLUDE A PLAN FOR TRAINING AND SUPPORTING APPRENTICE22 MENTOR TEACHERS;23 (c) I NCLUDE A WAGE SCALE COMMENSURATE WITH EXISTING PAY24 SCALES OF LOCAL EDUCATION PROVIDERS BASED ON THE LEVEL OF WORK25 BEING PERFORMED;26 (d) T HE APPROVED TEACHER DEGREE APPRENTICESHIP PROGRAM27 087 -10- INCORPORATES A BACHELOR 'S DEGREE FROM AN ACCREDITED1 INSTITUTION IN A RELATED FIELD OF STUDY RELATIVE TO THE2 ENDORSEMENT AREA THAT THE PROGRAM 'S PARTICIPANTS WILL PURSUE.3 T HE BACHELOR'S DEGREE PROGRAM DOES NOT NEED TO BE AN APPROVED4 EDUCATOR PREPARATION PROGR AM PURSUANT TO SECTION 23-1-121.5 (e) T HE BACHELOR'S DEGREE PROGRAM REFERENCED IN6 SUBSECTION (4)(d) OF THIS SECTION MUST INCORPORATE ON -THE-JOB7 TRAINING IN MEANINGFUL AND TIME-SAVING WAYS THROUGH ONE OF THE8 FOLLOWING MECHANISMS :9 (I) O FFERING THIRTY OR MORE CREDITS FOR SUCCESSFULLY10 COMPLETING ON-THE-JOB TRAINING;11 (II) C REATING A RESIDENCY MODEL THAT CLOSELY INTEGRATES 12 COURSE WORK AND CLINICAL EXPERIENCE WITH RELEVANT AND13 CONNECTED ASSIGNMENTS CARRIED OUT IN THE CLINICAL EXPERIENCE14 THAT COUNTS AS TWENTY-FIVE PERCENT OR MORE TOWARD THE DEGREE ;15 (III) E MBEDDING ON-THE-JOB LEARNING INTO THE HOMEWORK OR 16 ASSIGNMENT REQUIREMENTS OF TWENTY -FIVE PERCENT OR MORE OF THE17 COURSES WITHIN THE DEGREE; OR18 (IV) O PERATING AS A COMPETENCY-BASED BACHELOR'S DEGREE19 PROGRAM.20 (5) (a) E VERY FIVE YEARS AFTER PROGRAM APPROVAL , THE STATE21 DEPARTMENT OF EDUCATION SHALL CONSULT WITH THE UNITED STATES22 DEPARTMENT OF LABOR 'S APPRENTICESHIP OFFICE , OR STATE23 APPRENTICESHIP AGENCY REPRESENTATIVES , REGARDING THE AUDIT24 REQUIRED PURSUANT TO 29 CFR 29.3 TO REVIEW PROGRAM COMPLIANCE25 AND AUDIT FINDINGS TO ENSURE THE APPROVED TEACHER DEGREE26 APPRENTICESHIP PROGRAM CONTINUES TO MEET THE REQUIREMENTS . AN27 087 -11- APPROVED TEACHER DEGREE APPRENTICESHIP PROGRAM THAT DOES NOT1 MEET THE REQUIREMENTS IS SUBJECT TO DISQUALIFICATION BY THE STATE2 DEPARTMENT OF EDUCATION .3 (b) I F DISQUALIFIED, THE TEACHER APPRENTICESHIP PROGRAM4 SPONSOR MAY CONTINUE TO OPERATE THE TEACHER DEGREE5 APPRENTICESHIP PROGRAM ONLY AS LONG AS NECESSARY TO ALLOW THE6 ACTIVELY REGISTERED APPRENTICES TO FINISH .7 (c) I F THE TEACHER APPRENTICESHIP PROGRAM SPONSOR8 REDESIGNS THE TEACHER DEGREE APPRENTICESHIP PROGRAM TO MEET THE9 REQUIREMENTS, AND THE STATE BOARD OF EDUCATION APPROVES THE10 REDESIGNED TEACHER DEGREE APPRENTICESHIP PROGRAM , THE TEACHER11 APPRENTICESHIP PROGRAM SPONSOR MAY REINSTATE APPRENTICESHIP12 AUTHORIZATION, PROVIDED THE TEACHER APPRENTICESHIP PROGRAM13 SPONSOR MEETS THE REQUIREMENTS FOR APPROVAL .14 (6) T HE STATE DEPARTMENT OF EDUCATION SHALL ANNUALLY15 INCLUDE DATA ON TEACHER DEGREE APPRENTICESHIP PROGRAMS IN THE16 EXISTING EDUCATOR PREPARATION PROGRAM REPORT DASHBOARD ,17 CONSISTENT WITH THE DATA AND REPORTING REQUIREMENTS IN SECTION18 22-2-112 (1)(q). T HE DEPARTMENT SHALL COORDINATE WITH THE UNITED19 S TATES DEPARTMENT OF LABOR 'S OFFICE OF APPRENTICESHIP OR THE 20 STATE APPRENTICESHIP AGENCY TO SOURCE THE DATA .21 SECTION 5. In Colorado Revised Statutes, 22-60.5-201, amend22 (1)(c)(II) introductory portion and (1)(c)(II)(B); and add (1)(c)(II)(C) as23 follows:24 22-60.5-201. Types of teacher licenses issued - term - rules.25 (1) The department is designated as the sole agency authorized to issue26 the following teacher licenses to persons of good moral character:27 087 -12- (c) Professional teacher license. (II) The department of1 education may, in its discretion, issue a professional teacher license to any2 applicant who:3 (B) Has previously held a professional teacher license issued4 pursuant to this article ARTICLE 60.5 or an equivalent certificate which5 THAT was issued pursuant to article 60 of this title TITLE 22 prior to July6 1, 1994; OR7 (C) H OLDS A CERTIFICATE OF APPRENTICESHIP COMPLETION FROM8 AN APPROVED TEACHER DEGREE APPRENTICESHIP PROGRAM PURSUANT TO9 SECTION 22-60.5-111.10 SECTION 6. Appropriation. (1) For the 2023-24 state fiscal 11 year, $116,134 is appropriated to the department of education. This12 appropriation is from the general fund. To implement this act, the13 department may use this appropriation as follows:14 (a) $89,699 for the teacher degree apprenticeship program, which15 amount is based on an assumption that the department will require an16 additional 0.8 FTE; and17 (b) $26,435 for the purchase of legal services.18 (2) For the 2023-24 state fiscal year, $26,435 is appropriated to19 the department of law. This appropriation is from reappropriated funds20 received from the department of education under subsection (1)(b) of this21 section and is based on an assumption that the department of law will22 require an additional 0.1 FTE. To implement this act, the department of23 law may use this appropriation to provide legal services for the24 department of education.25 SECTION 7. Act subject to petition - effective date. This act26 takes effect at 12:01 a.m. on the day following the expiration of the27 087 -13- ninety-day period after final adjournment of the general assembly; except1 that, if a referendum petition is filed pursuant to section 1 (3) of article V2 of the state constitution against this act or an item, section, or part of this3 act within such period, then the act, item, section, or part will not take4 effect unless approved by the people at the general election to be held in5 November 2024 and, in such case, will take effect on the date of the6 official declaration of the vote thereon by the governor.7 087 -14-
