Beginning with state fiscal year 2025-26, and for each state fiscal year thereafter, a member who resides within the Denver metropolitan area is entitled to an amount equal to 25% of the federal per diem rate for the city and county of Denver as of October 1 of the calendar year immediately preceding the fiscal year the rate is used in, rounded up to the nearest whole dollar, and a member who does not reside within the Denver metropolitan area is entitled to an amount equal to 90% of that rate, rounded up to the nearest whole dollar. Section 2 creates the independent state elected official pay commission (commission) which shall set compensation for members of the general assembly, the governor, the lieutenant governor, the attorney general, the secretary of state, and the state treasurer (state elected officials). The initial commission will: ! Be appointed on or before July 31, 2025; ! Hold its first meeting on or before September 1, 2025; and ! Submit its report on or before December 15, 2025. The compensation set by the initial commission, unless rejected or modified by the general assembly, will go into effect on January 1, 2027. After a commission submits its report, the commission expires. After the initial commission, subsequent commissions will meet every 4 years after 2025 so that the effective date of future recommendations is in alignment with the election cycle of the governor, the lieutenant governor, the attorney general, the secretary of state, and the state treasurer. A subsequent commission will: ! Be appointed on or before July 31 of each year in which the commission meets; ! Hold its first meeting on or before September 1 of each year in which the commission meets; and ! Submit its report on or before December 15 of each year in which the commission meets. The compensation set by commissions subsequent to the initial commission, unless rejected or modified by the general assembly, will go into effect on January 1 of the first year of each subsequent 4-year gubernatorial term. Additionally, the director of research of the legislative council must annually adjust the compensation levels set by the commission for inflation except in the year in which a commission's recommendations take effect. Sections 3 and 4 make conforming changes in accordance with the commission setting compensation for state elected officials beginning on and after January 1, 2027. Be it enacted by the General Assembly of the State of Colorado:1 1059-2- SECTION 1. Legislative declaration. (1) The general assembly1 finds and declares that it is the intent of the general assembly in creating2 the independent state elected official pay commission that the initial3 commission and each subsequent commission thereafter be established as4 an independent and temporary commission comprised of Coloradans who5 reflect the state's diversity with regard to geography, ethnicity, race,6 gender, sexual orientation, gender identity, disability, age, and7 socioeconomic background.8 SECTION 2. In Colorado Revised Statutes, 2-2-317, amend9 (1)(a) introductory portion, (1)(b)(II) introductory portion, (1)(b)(II)(A),10 (1)(c)(II), (2)(a), and (2)(b); and add (1)(b.5) as follows:11 2-2-317. Expense, subsistence, and travel allowance -12 definitions. (1) (a) Except as provided in paragraph (b) of this subsection13 (1), SUBSECTION (1)(b) OF THIS SECTION, each member of the general14 assembly shall be IS entitled to receive up to forty-five dollars per15 legislative day UNTIL JUNE 30, 2025, for expenses incurred during the16 sessions of the general assembly. Such allowance shall be considered as17 salary pursuant to section 24-51-101 (42). C.R.S. Each member of the18 general assembly who is serving on July 1, 1997, and who is entitled to19 such allowance may elect to have all of such allowance that was paid to20 the member during the period from January 1, 1992, through May 31,21 1994, be considered salary pursuant to section 24-51-101 (42), C.R.S.,22 subject to the following conditions:23 (b) (II) In lieu of the expenses allowed in subsection (1)(a) of this24 section, if a member does not reside in the Denver metropolitan area,25 which area shall be designated in guidelines established by the executive26 committee of legislative council, the member shall be IS entitled to27 1059 -3- receive per legislative day for expenses incurred during the sessions of1 the general assembly up to an amount equal to the following:2 (A) For fiscal years commencing prior to July 1, 2020, and on or3 after July 1, 2021, BUT BEFORE JULY 1, 2025, eighty-five percent of the4 federal per diem rate for the city and county of Denver, rounded up to the5 nearest whole dollar, as determined by the United States general services6 administration, or such succeeding entity, as of October 1 of the calendar7 year immediately preceding the fiscal year in which the per diem rate is8 to be used; and9 (b.5) (I) F OR FISCAL YEARS COMMENCING ON OR AFTER JULY 1,10 2025, EACH MEMBER OF THE GENERAL ASSEMBLY IS ENTITLED TO RECEIVE11 PER LEGISLATIVE DAY FOR EXPENSES INCURRED DURING THE SESSIONS OF12 THE GENERAL ASSEMBLY UP TO AN AMOUNT EQUAL TO THE FOLLOWING :13 (A) F OR A MEMBER THAT RESIDES IN THE DENVER METROPOLITAN14 AREA, WHICH AREA SHALL BE DESIGNATED IN GUIDELINES ESTABLISHED BY15 THE EXECUTIVE COMMITTEE OF LEGISLATIVE COUNCIL , TWENTY-FIVE16 PERCENT OF THE FEDERAL PER DIEM RATE FOR THE CITY AND COUNTY OF17 D ENVER, ROUNDED UP TO THE NEAREST WHOLE DOLLAR , AS DETERMINED18 BY THE UNITED STATES GENERAL SERVICES ADMINISTRATION , OR SUCH19 SUCCEEDING ENTITY, AS OF OCTOBER 1 OF THE CALENDAR YEAR20 IMMEDIATELY PRECEDING THE FISCAL YEAR IN WHICH THE PER DIEM RATE21 IS TO BE USED; AND22 (B) F OR A MEMBER THAT DOES NOT RESIDE IN THE DENVER23 METROPOLITAN AREA, WHICH AREA SHALL BE DESIGNATED IN GUIDELINES24 ESTABLISHED BY THE EXECUTIVE COMMITTEE OF LEGISLATIVE COUNCIL ,25 NINETY PERCENT OF THE FEDERAL PER DIEM RATE FOR THE CITY AND26 COUNTY OF DENVER, ROUNDED UP TO THE NEAREST WHOLE DOLLAR , AS27 1059 -4- DETERMINED BY THE UNITED STATES GENERAL SERVICES1 ADMINISTRATION, OR SUCH SUCCEEDING ENTITY, AS OF OCTOBER 1 OF THE2 CALENDAR YEAR IMMEDIATELY PRECEDING THE FISCAL YEAR IN WHICH3 THE PER DIEM RATE IS TO BE USED.4 (II) T HE ALLOWANCE PROVIDED IN SUBSECTION (1)(b.5)(I) OF THIS5 SECTION IS NOT SALARY, AS DEFINED IN SECTION 24-51-101 (42).6 (c) (II) The per diem lodging and expense allowances of the7 general assembly as fixed by subparagraph (II) of paragraph (b) of this 8 subsection (1) SUBSECTIONS (1)(b)(II) AND (1)(b.5) OF THIS SECTION shall9 apply to regular or special sessions of the general assembly subsequent to10 July 1, 2012.11 (2) (a) Each member of the general assembly who is entitled to12 claim a per diem lodging and expense allowance pursuant to paragraph13 (a) of subsection (1) SUBSECTIONS (1)(a) AND (1)(b.5)(I)(A) of this14 section shall IS also be entitled to receive travel expenses to such THE15 member's home and back to the capitol for each legislative day of actual16 attendance.17 (b) Each member of the general assembly who is entitled to claim18 an expense per diem pursuant to paragraph (b) of subsection (1)19 SUBSECTIONS (1)(b) AND (1)(b.5)(I)(B) of this section shall IS also be20 entitled to receive travel expenses to any location within such THE21 member's district and back to Denver once each week, pursuant to section22 2-2-316.23 SECTION 3. In Colorado Revised Statutes, add 24-9-106 as24 follows:25 24-9-106. Independent state elected official pay commission -26 creation - report - definitions. (1) A S USED IN THIS SECTION, UNLESS27 1059 -5- THE CONTEXT OTHERWISE REQUIRES :1 (a) "C OMMISSION" MEANS THE INDEPENDENT STATE ELECTED2 OFFICIAL PAY COMMISSION CREATED IN SUBSECTION (2) OF THIS SECTION.3 (b) "S TATE ELECTED OFFICIAL" MEANS A STATE OFFICER OR A4 MEMBER OF THE GENERAL ASSEMBLY .5 (c) "S TATE OFFICER" MEANS THE GOVERNOR , THE LIEUTENANT6 GOVERNOR, THE ATTORNEY GENERAL, THE SECRETARY OF STATE, OR THE7 STATE TREASURER.8 (2) T HE INDEPENDENT STATE ELECTED OFFICIAL PAY COMMISSION9 IS CREATED. THE COMMISSION SHALL SET COMPENSATION FOR STATE10 ELECTED OFFICIALS. THE COMMISSION SHALL MEET BEGINNING IN 202511 AND SHALL MEET EVERY FOUR YEARS THEREAFTER .12 (3) (a) T HE COMMISSION CONSISTS OF NINE APPOINTED MEMBERS .13 S UBJECT TO THE PROVISIONS SET FORTH IN SUBSECTION (3)(b) OF THIS14 SECTION, THE MEMBERS ARE APPOINTED AS FOLLOWS :15 (I) T HE GOVERNOR SHALL APPOINT THREE MEMBERS AS FOLLOWS :16 (A) O NE MEMBER WITH EXPERTISE IN PERSONNEL MANAGEMENT17 AND HUMAN RESOURCES ;18 (B) O NE MEMBER WITH EXPERTISE IN AGRICULTURAL LEADERSHIP ;19 AND20 (C) O NE MEMBER WITH LOCAL GOVERNMENT EXPERIENCE ;21 22 (II) T HE PRESIDENT OF THE SENATE SHALL APPOINT TWO MEMBERS,23 ONE MEMBER WITH EXPERTISE IN LARGE BUSINESS AND ONE MEMBER WITH24 EXPERTISE IN ORGANIZED LABOR;25 (III) T HE SPEAKER OF THE HOUSE SHALL APPOINT TWO MEMBERS,26 ONE MEMBER WITH EXPERTISE IN SMALL BUSINESS AND ONE MEMBER WHO27 1059 -6- IS PART OF A MINORITY CHAMBER OF COMMERCE OR BUSINESS LEADERSHIP1 ORGANIZATION;2 (IV) T HE MINORITY LEADER OF THE SENATE SHALL APPOINT A3 MEMBER WHO HAS EXPERTISE WITH SALARY SURVEYS AND TOTAL4 COMPENSATION ANALYSIS; AND5 (V) T HE MINORITY LEADER OF THE HOUSE OF REPRESENTATIVES6 SHALL APPOINT A MEMBER WHO HAS LARGE NONPROFIT LEADERSHIP7 EXPERIENCE.8 (b) T HE APPOINTMENT OF MEMBERS MUST BE IN ACCORDANCE9 WITH THE FOLLOWING REQUIREMENTS :10 (I) A MEMBER MUST BE A REGISTERED ELECTOR ;11 (II) A MEMBER MUST NOT BE A CURRENT OR FORMER STATE12 OFFICIAL, A CURRENT OR FORMER MEMBER OF THE GENERAL ASSEMBLY ,13 THE SPOUSE OF A CURRENT STATE OFFICIAL OR MEMBER OF THE GENERAL14 ASSEMBLY, OR A CANDIDATE TO BE A STATE ELECTED OFFICIAL ;15 (III) A MEMBER MUST NOT BE A REGISTERED LOBBYIST OR A16 PERSON WHO HAS LOBBIED AS A REGISTERED LOBBYIST IN THE EIGHT17 YEARS IMMEDIATELY PRECEDING THE APPOINTMENT DATE FOR THE18 MEMBER; AND19 (IV) A T ANY TIME, NO MORE THAN FOUR MEMBERS MAY BE FROM20 THE SAME POLITICAL PARTY AND NO MORE THAN TWO MEMBERS MAY BE21 FROM THE SAME CONGRESSIONAL DISTRICT OF THE STATE .22 (c) THE PRESIDENT OF THE SENATE SHALL DESIGNATE ONE OF THE23 MEMBERS THAT THE PRESIDENT OF THE SENATE APPOINTS TO SERVE AS THE24 CHAIRPERSON OF THE COMMISSION AND THE SPEAKER OF THE HOUSE25 SHALL DESIGNATE ONE OF THE MEMBERS THAT THE SPEAKER OF THE26 HOUSE APPOINTS TO SERVE AS THE VICE -CHAIRPERSON OF THE27 1059 -7- COMMISSION.1 (d) (I) T HE INITIAL COMMISSION MEMBERS SHALL BE APPOINTED2 ON OR BEFORE JULY 31, 2025, AND SHALL SERVE UNTIL THE SUBMISSION3 OF THE REPORT REQUIRED BY SUBSECTION (5)(a) OF THIS SECTION.4 (II) S UBSEQUENT COMMISSION MEMBERS SHALL BE APPOINTED ON5 OR BEFORE JULY 31 OF EACH YEAR IN WHICH THE COMMISSION MEETS AND6 SHALL SERVE UNTIL THE SUBMISSION OF THAT COMMISSION 'S REPORT.7 (III) E ACH COMMISSION EXPIRES UPON SUBMISSION OF THE8 COMMISSION'S REPORT.9 (4) (a) T HE CHAIRPERSON AND VICE-CHAIRPERSON OF THE INITIAL10 COMMISSION SHALL CONVENE THE FIRST MEETING OF THE COMMISSION NO11 LATER THAN SEPTEMBER 1, 2025, AND THE COMMISSION SHALL MEET AS12 MANY TIMES AS NECESSARY THEREAFTER BEFORE SUBMITTING THE13 REPORT REQUIRED BY SUBSECTION (5)(a) OF THIS SECTION.14 (b) A FTER THE INITIAL COMMISSION EXPIRES, THE CHAIRPERSON15 AND VICE-CHAIRPERSON OF SUBSEQUENT COMMISSIONS SHALL CONVENE16 THE FIRST MEETING OF A COMMISSION NO LATER THAN SEPTEMBER 1 OF17 EACH YEAR IN WHICH THE COMMISSION MEETS AND SUCH COMMISSIONS18 SHALL MEET AS MANY TIMES AS NECESSARY THEREAFTER BEFORE19 SUBMITTING THE REPORT REQUIRED BY SUBSECTION (5)(a) OF THIS20 SECTION.21 (5) (a) O N OR BEFORE DECEMBER 15, 2025, THE INITIAL22 COMMISSION, AND ON OR BEFORE DECEMBER 15 OF EACH YEAR23 THEREAFTER IN WHICH THE COMMISSION MEETS , SUBSEQUENT24 COMMISSIONS, SHALL SUBMIT A REPORT TO THE OFFICE OF STATE25 PLANNING AND BUDGETING CREATED IN SECTION 24-37-102, TO THE JOINT26 BUDGET COMMITTEE OF THE GENERAL ASSEMBLY , TO THE PRESIDENT27 1059 -8- OF THE SENATE, AND TO THE SPEAKER OF THE HOUSE OF REPRESENTATIVES1 THAT SETS FORTH THE COMMISSION 'S RECOMMENDATIONS FOR ANNUAL2 SALARIES AND ALLOWANCES FOR EACH STATE OFFICIAL AND FOR MEMBERS3 OF THE GENERAL ASSEMBLY.4 (b) E XCEPT AS OTHERWISE PROVIDED IN SUBSECTION (5)(c) OF5 THIS SECTION, THE SALARIES AND ALLOWANCES RECOMMENDED IN THE6 REPORT DUE ON OR BEFORE DECEMBER 15, 2025, TAKE EFFECT ON7 J ANUARY 1, 2027, AND THE SALARIES AND ALLOWANCES RECOMMENDED8 IN SUBSEQUENT REPORTS TAKE EFFECT ON JANUARY 1 OF THE FIRST YEAR9 OF EACH SUBSEQUENT FOUR-YEAR GUBERNATORIAL TERM IF THE GENERAL10 ASSEMBLY MAKES AN APPROPRIATION TO PAY THE RECOMMENDED11 SALARIES AND ALLOWANCES DURING THE LEGISLATIVE SESSION12 IMMEDIATELY PRECEDING SUCH YEAR .13 (c) B EFORE THE EFFECTIVE DATE OF THE RECOMMENDED SALARIES14 AND ALLOWANCES, THE GENERAL ASSEMBLY MAY MODIFY OR REJECT THE15 RECOMMENDATIONS .16 (6) (a) A NY REPORT SUBMITTED BY THE COMMISSION , AS REQUIRED17 BY SUBSECTION (5) OF THIS SECTION, MUST INCLUDE RECOMMENDATIONS18 REGARDING:19 (I) T HE AMOUNT OF THE ANNUAL BASE COMPENSATION FOR20 MEMBERS OF THE GENERAL ASSEMBLY AS ALLOWED BY SECTION 2-2-30721 (1)(b);22 (II) T HE AMOUNT OF ADDITIONAL COMPENSATION THAT MEMBERS23 OF THE GENERAL ASSEMBLY ARE ALLOWED FOR NECESSARY ATTENDANCE24 AT MEETINGS OR FUNCTIONS OR TO LEGISLATIVE MATTERS PURSUANT TO25 SECTION 2-2-307 (3)(a);26 (III) T HE AMOUNT OF THE ANNUAL SALARIES FOR STATE OFFICIALS27 1059 -9- ALLOWED PURSUANT TO SECTION 24-9-101; AND1 (IV) T HE SUM PER DAY ALLOWED AS EXPENSES TO THE PRESIDENT2 OF THE SENATE, SPEAKER OF THE HOUSE OF REPRESENTATIVES , MINORITY3 LEADER OF THE SENATE , OR MINORITY LEADER OF THE HOUSE OF4 REPRESENTATIVES WHILE FOR ANY REASON ACTING AS GOVERNOR5 PURSUANT TO SECTION 24-9-101 (1)(c).6 (b) I N MAKING THE RECOMMENDATIONS REQUIRED BY SUBSECTION7 (6)(a) OF THIS SECTION, THE COMMISSION SHALL CONSIDER THE AMOUNT8 OF COMPENSATION PAID IN GOVERNMENT SERVICE AND IN THE PRIVATE9 SECTOR TO PERSONS WITH SIMILAR QUALIFICATIONS , THE AMOUNT OF10 COMPENSATION NEEDED TO ATTRACT AND RETAIN EXPERIENCED AND11 COMPETENT PERSONS, AND THE ABILITY OF THE STATE TO PAY THE12 RECOMMENDED COMPENSATION .13 (7) O N OR AFTER JANUARY 1, 2028, BUT BEFORE JANUARY 1, 2029,14 AND BEFORE JANUARY 1 OF EACH YEAR THEREAFTER , EXCEPT FOR THE15 YEAR IN WHICH THE RECOMMENDATIONS OF A COMMISSION TAKE EFFECT16 PURSUANT TO THIS SECTION , THE DIRECTOR OF RESEARCH OF THE17 LEGISLATIVE COUNCIL APPOINTED PURSUANT TO SECTION 2-3-304 (1)18 SHALL ADJUST THE AMOUNT OF ANNUAL BASE COMPENSATION FOR19 MEMBERS OF THE GENERAL ASSEMBLY AND AMOUNT OF ADDITIONAL20 COMPENSATION ALLOWED TO MEMBERS OF THE GENERAL ASSEMBLY SET21 BY THE COMMISSION PURSUANT TO SUBSECTIONS (6)(a)(I) AND (6)(a)(II)22 OF THIS SECTION IN ACCORDANCE WITH THE PERCENTAGE CHANGE SINCE23 THE IMMEDIATELY PRECEDING JANUARY 1, IN THE UNITED STATES24 DEPARTMENT OF LABOR, BUREAU OF LABOR STATISTICS, CONSUMER PRICE25 INDEX FOR DENVER-AURORA-LAKEWOOD FOR ALL ITEMS AND ALL URBAN26 CONSUMERS, OR ITS APPLICABLE PREDECESSOR OR SUCCESSOR INDEX. THE27 1059 -10- DIRECTOR OF RESEARCH SHALL POST THE ADJUSTED ANNUAL SALARY1 AMOUNTS ON THE WEBSITE OF THE GENERAL ASSEMBLY .2 (8) T HE ANNUAL SALARY OF A STATE ELECTED OFFICIAL WHOSE3 TERM BEGINS ON OR AFTER THE DATE THE SALARIES GO INTO EFFECT4 PURSUANT TO SUBSECTION (5)(b) OF THIS SECTION OR, IF APPLICABLE,5 ADJUSTED PURSUANT TO SUBSECTION (7) OF THIS SECTION MUST BE AS SET6 BY THE COMMISSION, EXCEPT IF MODIFIED OR REJECTED BY THE GENERAL7 ASSEMBLY AND THEN AS SET BY THE GENERAL ASSEMBLY .8 (9) (a) T HE DEPARTMENT OF PERSONNEL CREATED IN SECTION9 24-50-102 (1) SHALL PROVIDE STAFF SERVICES AS NECESSARY TO10 IMPLEMENT THIS SECTION.11 (b) M EMBERS OF THE COMMISSION SERVE WITHOUT12 COMPENSATION BUT RECEIVE REIMBURSEMENT FOR REASONABLE TRAVEL13 EXPENSES TO ATTEND MEETINGS OF THE COMMISSION .14 SECTION 4. In Colorado Revised Statutes, 2-2-307, amend15 (1)(b) and (3)(a) introductory portion; and add (6) as follows:16 2-2-307. Compensation of members - reimbursement of17 expenses - definition - repeal. (1) (b) (I) Except as otherwise provided18 in subsection (1)(b)(II) of this section, commencing on the first day of the19 legislative session beginning in January of 2019, and the first day of each20 legislative session beginning in January each two years thereafter, BUT21 BEFORE JANUARY 1, 2027, all members of the general assembly whose22 terms commence on such day and members appointed to fill vacancies for23 unexpired terms of those members shall receive as an annual base24 compensation for their services an amount equal to twenty-five percent25 of the total annual salary paid as of such day to the judges of the county26 court in Class B counties, as defined in section 13-6-201. The base 27 1059 -11- compensation shall be payable in twelve equal monthly amounts. The1 director of research of the legislative council appointed pursuant to2 section 2-3-304 (1) shall post the amount of the current annual base3 compensation payable to a member of the general assembly pursuant to4 this subsection (1)(b) on the website of the general assembly. THIS5 SUBSECTION (1)(b)(I) IS REPEALED, EFFECTIVE JULY 1, 2028.6 (II) For the period commencing on the first day of the legislative7 session beginning in January of 2021, and ending on the day before the8 first day of the legislative session beginning in January of 2022, all9 members of the general assembly whose terms commence on the first day10 of the legislative session beginning in January of 2021 shall receive as an11 annual base compensation for their services forty thousand two hundred12 forty-two dollars, which is the same amount as the annual base13 compensation for their services for members of the general assembly14 whose terms commenced on the first day of the legislative session15 beginning in January of 2019. T HIS SUBSECTION (1)(b)(II) IS REPEALED,16 EFFECTIVE JULY 1, 2028.17 (III) O N OR AFTER JANUARY 1, 2027, ALL MEMBERS OF THE18 GENERAL ASSEMBLY SHALL RECEIVE FOR THEIR SERVICES AN ANNUAL19 BASE COMPENSATION IN THE AMOUNT SET BY THE COMMISSION .20 (IV) T HE BASE COMPENSATION FOR ALL MEMBERS OF THE21 GENERAL ASSEMBLY IS PAYABLE IN TWELVE EQUAL MONTHLY AMOUNTS .22 T HE DIRECTOR OF RESEARCH OF THE LEGISLATIVE COUNCIL APPOINTED23 PURSUANT TO SECTION 2-3-304 (1) SHALL POST THE AMOUNT OF THE24 CURRENT ANNUAL BASE COMPENSATION PAYABLE TO A MEMBER OF THE25 GENERAL ASSEMBLY PURSUANT TO THIS SUBSECTION (1)(b) ON THE26 WEBSITE OF THE GENERAL ASSEMBLY .27 1059 -12- (3) (a) When the general assembly is in recess for more than three1 days or is not in session, in addition to the base compensation specified2 in subsection (1) of this section, the following members of the general3 assembly shall be entitled to the further sum of ninety-nine dollars per day4 THROUGH DECEMBER 31, 2026, AND, ON OR AFTER JANUARY 1, 2027, THE5 AMOUNT SET BY THE COMMISSION for necessary attendance at meetings or6 functions or to legislative matters as follows:7 (6) A S USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE8 REQUIRES, "COMMISSION" MEANS THE INDEPENDENT STATE ELECTED9 OFFICIAL PAY COMMISSION CREATED IN SECTION 24-9-106 (2).10 SECTION 5. In Colorado Revised Statutes, 24-9-101, amend11 (1)(a)(II)(B), (1)(b)(II)(B), (1)(b)(III), (1)(b)(IV), (1)(c), (1)(d)(II)(B),12 (1)(e)(II)(B), (1)(f)(II)(B), and (4); and add (1)(a)(II)(C), (1)(a)(III),13 (1)(b)(II)(C), (1)(b)(V), (1)(d)(II)(C), (1)(d)(III), (1)(e)(II)(C), (1)(e)(III),14 (1)(f)(II)(C), (1)(f)(III), and (6) as follows:15 24-9-101. Salaries of elected state officials - definition - repeal.16 (1) The following state officials shall receive annual salaries and17 allowances, payable monthly, as follows:18 (a) Governor:19 (II) (B) B EFORE JANUARY 1, 2027, each subsequent salary paid20 under this paragraph (a) SUBSECTION (1)(a) must be adjusted on a21 quadrennial basis so that, beginning with the first day of each four-year22 gubernatorial term, and applying to each year of that term, the governor's23 annual salary is an amount equal to sixty-six percent of the total annual24 salary earned by the chief justice of the supreme court on the first day of25 the governor's term.26 (C) T HIS SUBSECTION (1)(a)(II) IS REPEALED, EFFECTIVE JULY 1,27 1059 -13- 2028.1 (III) O N OR AFTER JANUARY 1, 2027, THE SALARY PAYABLE TO THE2 GOVERNOR FOR EACH YEAR OF THE FOUR -YEAR TERM BEING SERVED IS IN3 THE AMOUNT SET BY THE COMMISSION .4 (b) Lieutenant governor:5 (II) (B) B EFORE JANUARY 1, 2027, each subsequent salary paid6 under this paragraph (b) SUBSECTION (1)(b) must be adjusted on a7 quadrennial basis so that, beginning with the first day of each four-year8 term, and applying to each year of that term, the lieutenant governor's9 annual salary is an amount equal to fifty-eight percent of the total annual10 salary earned by the judges of the county court in Class B counties on the11 first day of the lieutenant governor's term.12 (C) T HIS SUBSECTION (1)(b)(II) IS REPEALED, EFFECTIVE JULY 1,13 2028.14 (III) Notwithstanding any provision of subparagraph (II) of this 15 paragraph (b) THIS SUBSECTION (1)(b) to the contrary, if the lieutenant16 governor is concurrently serving as the head of a principal department and17 the salary for the head of that principal department is greater than that to18 which the lieutenant governor is entitled under this paragraph (b)19 SUBSECTION (1)(b), the lieutenant governor shall also be paid that portion20 of the salary for the head of the principal department that, when added to21 the amount of the salary paid under this paragraph (b) SUBSECTION (1)(b),22 equals the amount paid to the head of that principal department.23 (IV) Notwithstanding subsection (1)(b)(II) of this section ANY24 PROVISION OF THIS SUBSECTION (1)(b) TO THE CONTRARY, if the lieutenant25 governor is concurrently serving as the director of the office of saving26 people money on healthcare within the office of the governor and the27 1059 -14- salary for the director of the office of saving people money on healthcare1 is greater than the amount to which the lieutenant governor is entitled2 under this subsection (1)(b), the lieutenant governor shall also be paid that3 portion of the salary for the director of the office of saving people money4 on healthcare that, when added to the amount of the salary paid under this5 subsection (1)(b), equals the amount paid to the director of the office of6 saving people money on healthcare.7 (V) O N OR AFTER JANUARY 1, 2027, THE SALARY PAYABLE TO THE8 LIEUTENANT GOVERNOR FOR EACH YEAR OF THE FOUR -YEAR TERM BEING9 SERVED IS IN THE AMOUNT SET BY THE COMMISSION .10 (c) President of the senate, speaker of the house of representatives,11 minority leader of the senate, or minority leader of the house of12 representatives, while for any reason acting as governor:13 (I) B EFORE JANUARY 1, 2027, the sum of twenty dollars per day14 as expenses; AND15 (II) O N OR AFTER JANUARY 1, 2027, THE AMOUNT SET BY THE16 COMMISSION AS EXPENSES.17 (d) Attorney general:18 (II) (B) B EFORE JANUARY 1, 2027, each subsequent salary paid19 under this paragraph (d) SUBSECTION (1)(d) must be adjusted on a20 quadrennial basis so that, beginning with the first day of each four-year21 term, and applying to each year of that term, the attorney general's annual22 salary is an amount equal to sixty percent of the total annual salary earned23 by the chief judge of the court of appeals on the first day of the attorney24 general's term.25 (C) T HIS SUBSECTION (1)(d)(II) IS REPEALED, EFFECTIVE JULY 1,26 2028.27 1059 -15- (III) ON OR AFTER JANUARY 1, 2027, THE SALARY PAYABLE TO THE1 ATTORNEY GENERAL FOR EACH YEAR OF THE FOUR -YEAR TERM BEING2 SERVED IS IN THE AMOUNT SET BY THE COMMISSION .3 (e) Secretary of state:4 (II) (B) B EFORE JANUARY 1, 2027, each subsequent salary paid5 under this paragraph (e) SUBSECTION (1)(e) must be adjusted on a6 quadrennial basis so that, beginning with the first day of each four-year7 term, and applying to each year of that term, the secretary of state's annual8 salary is an amount equal to fifty-eight percent of the total annual salary9 earned by the judges of the county court in Class B counties on the first10 day of the secretary of state's term.11 (C) T HIS SUBSECTION (1)(e)(II) IS REPEALED, EFFECTIVE JANUARY12 1, 2028.13 (III) O N OR AFTER JANUARY 1, 2027, THE SALARY PAYABLE TO THE14 SECRETARY OF STATE FOR EACH YEAR OF THE FOUR -YEAR TERM BEING15 SERVED IS IN THE AMOUNT SET BY THE COMMISSION .16 (f) State treasurer:17 (II) (B) B EFORE JANUARY 1, 2027, each subsequent salary paid18 under this paragraph (f) SUBSECTION (1)(f) must be adjusted on a19 quadrennial basis so that, beginning with the first day of each four-year20 term, and applying to each year of that term, the state treasurer's annual21 salary is an amount equal to fifty-eight percent of the total annual salary22 earned by the judges of the county court in Class B counties on the first23 day of the state treasurer's term.24 (C) T HIS SUBSECTION (1)(f)(II) IS REPEALED, EFFECTIVE JULY 1,25 2028.26 (III) O N OR AFTER JANUARY 1, 2027, THE SALARY PAYABLE TO THE27 1059 -16- STATE TREASURER FOR EACH YEAR OF THE FOUR -YEAR TERM BEING1 SERVED IS IN THE AMOUNT SET BY THE COMMISSION .2 (4) Nothing in this section authorizes the salary of any elected3 state official to be modified while he or she is serving his or her DURING4 THE ELECTED STATE OFFICIAL'S official term.5 6 (6) A S USED IN THIS SECTION, UNLESS THE CONTEXT OTHERWISE7 REQUIRES, "COMMISSION" MEANS THE INDEPENDENT STATE ELECTED8 OFFICIAL PAY COMMISSION CREATED IN SECTION 24-9-106 (2).9 SECTION 6. Act subject to petition - effective date. This act10 takes effect at 12:01 a.m. on the day following the expiration of the11 ninety-day period after final adjournment of the general assembly; except12 that, if a referendum petition is filed pursuant to section 1 (3) of article V13 of the state constitution against this act or an item, section, or part of this14 act within such period, then the act, item, section, or part will not take15 effect unless approved by the people at the general election to be held in16 November 2024 and, in such case, will take effect on the date of the17 official declaration of the vote thereon by the governor.18 1059 -17-
